Death Curve Scene Of Third Fatality

Josiah Eby Succumbs To Injuries Received When Truck Shatters Telephone Post

LORNE MARSHALL IN HOSPITAL BADLY HURT

Harry Heinrich Charged With Reckless Driving Following Highway Tragedy

Josiah Eby is dead, Lorne Marshall is in a Kitchener hospital suffering from severe injuries, Harry Heinrich of St. Jacobs faces a charge of reckless driving while a big truck owned by Mr. Chris Dreisinger is a total wreck following an accident at the curve in the highway about a mile south of Elmira Friday afternoon.

A preliminary Inquest was held Tuesday to inquire into the death of Eby, with Dr. LeRoy Wagner as coroner, but following the viewing of the remains the investigation was post-poned until Monday, June 3. By this time it is hoped that Marshall will be in condition to offer more light on the episode which ended so tragically.

    IS THIRD DEATH

The accident occurred within 100 feet of where two persons were killed last August, where the road follows an elongated S formation. Just how the accident happened is still not definitely known but the authorities are working on the theory that the death car and that operated by Heinrich were being driven at a fast rate of speed perhaps were racing.

Mr. Noah Martin, a hired man employed on the farm of Clayton Martin whose farm abuts the road at this point, was the only witness of the accident.

According to his statement he heard the truck coming along at a high rate of speed and watched to discover how it would negotiate the curve. It left the road just before making the last bend and rammed a telephone post head on. The big timber cracked like a match under the force of the impact. The truck turned over and a portion of it was pitched over the fence while the two victims were tossed out. Eby was found in a half-sitting position near the shattered post while Marshall was about 15 feet away. The former was quite evidently seriously hurt and unconscious. His right leg was terribly mangled and the left apparently fractured. Marshall when picked up recovered and as he wiped the blood from a terrible gash over his eye asked for a cigarette and inquired faintly about Eby.

Dr. LeRoy Wagner. returning from a call, came upon the scene of the accident and after rendering first aid hurried the two injured men to the hospital.

    HORRIBLY INJURED

At the hospital it was found that Eby's leg was torn to the bone from the knee to ankle while the other leg was broken in two places. Infection to the mangled leg was the cause of death. Marshall is suffering from the gash over his eye and his vision is threatened. A portion of the bone is missing and the physicians fear that his head may be fractured. His condition is reported as serious.

From the Information available Marshall borrowed the Dreisinger truck to gather up the Royal hotel laundry from a home in town where it is laundered. Apparently he later went 'to St. Jacobs and it was on his return trip with Eby that the accident happened.

Members of the jury are H. 0. and Hilbert Weichel, Oscar and Fred Ruppel, W. Winter, C. Playford, M. N. Bearinger, E. A. McQuay and A. Winger, Foreman. Chief of Police Bromely was on the scene of the accident early and took charge of the investigation.
