    Notes:

    Oscar S. Eby has been described as a humorist and philosopher, a man whose kindly wit was much appreciated. He was the founder and publisher of the Hespeler Herald. His family moved to Preston in 1883 where his father was a miller in the Cherry Flour Mill. He worked for a time for the Preston Progress and later while still young travelled Western Ontario working for several magazines. He in 1895 partnered with Thomas H. Sears to published the first Hespeler Herald. He purchased Sear's interest in 1896 and remained as editor and proprietor for 23 years. In 1917 he was appointed as Registrar of the County of Waterloo. In 1918 he sold his interest in the paper and moved to Kitchener.

    Oscar S. Eby

    Oscar S. Eby, 30 Hohner avenue, former newspaperman and retired registrar of Waterloo county, who died suddenly at an outdoor camp near Birch Island in the Sudbury district Monday evening, had just seated himself after helping to extinguish a fire on the roof of the cabin at which he was staying when he collapsed, investigation showed death was due to natural causes. He was in his 86th year. The deceased, who has been a very prominent man in this district for many years was born at Salem, June 21 1871, a son of the late Mr. and Mrs Andrew Eby. He was married at Galt to Elisabeth Bolduc in 1899. Before his appointment as registrar of deeds, Mr. Eby owned and edited the Hespeler Herald. He was appointed registrar in 1917. The deceased led a public life, being past President of the Ontario Registratr Association, past president of Canada Lacrosse Association, Hespeler, and past president of Canadian Patriotic Association. He was a member of the Granite Club, Canadian order of Foresters and a member of Toronto Transportation Club. He was prominent in Conservative Circles and also in sports. He played soccer, baseball and was an ardent bowler. Serviving are his widow, one daughter Miss Norma, Kitchener, one brother, Herbert A. Eby, Washington, DC. and one nephew. Dr. Herbert Eby. Funeral services will be held publicly on Saturday morning from his late residence at 10 o'clock to St. Mary's church, with entombment in Woodland Mausoleum. The remains will rest at his late residence after Thursday morning.

    Oscar Eby Dies on North Trip

    Former Hespeler Editor and Registrar Succumbs to Heart Attack.

    KITCHENER, June 8. -
    Oscar S. Eby, former registrar of deeds for Waterloo County, dropped dead at a McGregor Bay hunting lodge last night, it was learned here to-day. He was one of Kitchener's best known residents. Mr. Eby and James V. Jardine, Hespeler, left for the camp near Espanola, Ont., on Friday. Mr. Jardine is in hospital at Espanola suffering from shock. Oscar Eby, a former newspaper man, was prominent in sports and politics here before he assumed the registrar's office. He was born at Preston 65 years ago and resided at Hawkesville and Millbank before he took over The Hespeler Herald in 1895. He sold the paper in 1918 when he was appointed registrar. Mr. Eby was a former secretary of the South Waterloo Conservative Association, past president of the Ontario Lacrosse Association, secretary of the Patriotic Association of Hespeler, former president of the Ontario Registrars of Deeds Asso- ciation. He was an ardent bowler and hunter. He leaves his wife, one daughter, Norma, at home; a brother, H. A. Eby, of Washington.

    Mrs. Magdalena Eby

    Mrs. Magdalena Eby of Preston, widow of the late Andrew Eby passed away on Saturday at St. Mary's Hospital, in her 76th year. She was the mother of Oscar Eby of Kitchener, former registrar. She was born on what is now known as the Woods farm on the Breslau road and lived in Preston for 50 years. She was a member of St. Clement's Church, Preston, and of the Altar Society. She is survived by two sons, Oscar of Kitchener and Herbert A. Eby of Washington, D.C., and by two grandchildren, Miss Norma Eby of Kitchener and Dr. Herbret 0. Eby of Washington, D.C. Her husband, a former Preston assessor and tax collector, died 14 years ago. The funeral was held on Tuesday morning at St. Clement's Church with entombment in the Woodland Mausoleum at Kitchener.

    Jacob B. Eby, "the seventh son of Bishop Benjamin Eby, was born March 24th, 1826. After his marriage, in September, 1845, to Lucy Kauffman (born February 26th, 1830, and died September 24th, 1877), he moved on his farm three miles north of the town of Waterloo, Ontario, where he resided for a number of years. He afterwards went into the milling business in partnership with his brother, Elias, having purchased Barnabas Devitt's interest in the firm of Eby & Devitt, Bridgeport, Ontario. In 1867 he sold his interest in the Bridgeport Mills and purchased the Salem Mills where he carried on business for some years. Some time within the years 1875-76 he disposed of his Salem property and moved to the town of Waterloo where his wife, Lucy Kauffman died. On September 16th, 1878, he was married a second time to Elizabeth Schill (born May 12th, 1848), to whom his youngest child was born. He died December 21st, 1882. He had a large family"

    A-2-6 Joseph Bechtel Last Will and Testament of Joseph Bechtel, late of the village of Preston, who died on or about the 14th September 1858 at the Village of Preston, and who at the time of his death had a fixed place of abode at the Village of Preston. Administration of all and singular, the personal estate granted by Abram A. Erb of the Village of Preston, Merchant, and Henry Hagey of the Township of Waterloo, Yeoman, the Executors named in said Will….

    This is the last Will and Testament of Joseph Bechtel of Preston, Yeoman. I will and desire that all my just debts, funeral and testamentary expenses be paid by my Executors…I give and devise unto my beloved wife Magdalena during the term of her natural life the homestead wherein I now dwell, being part of the broken front Lot number four in what is commonly called Richard Beasly's Lower Block of the Township of Waterloo, and which said lot is now within the boundaries of the Corporation of Preston. And I also give and devise unto my beloved wife all my farming stock, implements, as also my furniture or so much thereof as she may choose to keep, to hold to her during the term of her natural life, which said devices I give to her in lieu of Dower. And my will is further that upon the decease of my said wife, my Executors do sell my said homestead as also all the remainder of my other estate, both real and personal of what nature or kind so ever and to dispose thereof to the best advantage as they may think proper and divide the proceeds thereof unto and among my four children viz: Christian, Elizabeth, Samuel and Joseph in manner following, that is to say: the said Christian and Elizabeth shall receive one sixth of such proceeds each, and the said Samuel and Joseph shall receive one third of such proceeds each, provided always that if any of my sons shall not then have arrived at the age of maturity, his share shall be placed on interest until he has attained the age of maturity. And I give and bequeath all other my real and personal estate note herein before divided or bequeathed or not chosen, to be kept by my said wife as aforesaid, unto my Executors in trust to dispose therof to the best advantage and after paying all my jut debts, funeral and testamentary expenses in trust pay unto my said wife one third of the remainder and to divide the other two thirds of such remainder unto and among my said four children in the same manner and under the same proviso as heretofore mentioned for the division of that part of my estate. And in the event of such last mentioned other real and personal estate shall prove insufficient to pay my said just debts, funeral, and testamentary expenses my will then is that my Executors do sell and dispose of so much of my said homestead as will be ample and sufficient to make up the deficiency. And in the event of my said wife not desiring to remain on the said homestead or not desiring to farm the same or the whole of the same, that then in any or either of such cases my will is, that my Executors do dispose of the said homestead or so much thereof as my said wife does not desire to farm and the proceeds thereof, shall be placed and put on interest for the benefit and use of my said wife during the time of her natural life, and upon her decease be divided by my
    Executors unto and among my said four children in the same manner and under the same proviso as heretofore mentioned for the division of my estate. And I hereby give and grant unto my Executors full power and authority to sell and dispose of any of my estate in manner aforesaid and to grant a Deed of Deeds of Conveyance for the same in as ample a manner as I myself could do were I living. And I also do allow my Executors to pay and reimburse themselves for any expenses, loss of time, or other disbursements, which they may be subject to in executing this my Last Will and Testament. And I nominate and appoint my friends Abram A. Erb of Preston, aforesaid Merchant, and Henry Hagey of the Township of Waterloo, Yeoman, to be the Executors of this my Last Will and Testament….
