    Notes:

A-1-4 Henry Schwartz: The Last Will and Testament of Henry Schwartz, late of the Township of Waterloo.

…Henry Schwartz, of the Township of Waterloo, being of sound mind. "I commit my soul into the hands of almighty God, and my body in a spiritual manner the earth." He appointed Peter Schwartzs Jnr. of the Township of Waterloo, and Joseph Strub Snr. of the Township of Wilmot to act as executors. "I allow my wife, Elizabeth Laub to remain for four years on my lots of land." Lots forty-one of the Dutch Company Land in the upper block of the Township of Waterloo, and a five-acre lot of bush land bought from Christian Burkholder. Should his wife Elizabeth Laub marry before the four years have expired, then the lots, with everything belonging to them, are to be rented out, the rent to be equally divided among the surviving children. Four years after "my death, my eldest son John Swartz is to take possession of my lots, if he wishes them, for the sum of two hundred pounds." If not, the lots are to be sold to the highest bidder. "I will my lots and all the premises and appurtenances belonging thereto to my son John Swartz for the sum of two hundred pounds, to be paid in the following manner, without interest, namely, to my wife, Elizabeth Laub, in four annual installments from the year 1856." Twenty-five pounds each to son John Schwartz, daughter Catharine Schwartz, son Philip Schwarts, son Joseph Schwartz and daughter Susanna Schwartz. Daughters Elizabeth Schwartz and Mary Schwartz, and son Henry Schwartz, are each to receive twelve pounds and ten shillings. Twelve pounds ten shillings are to be expended upon a one-story frame house, 18x22 feet, to be built on an acre of land of the said five-acre lot purchased from Christian Burkholder. The said frame house and acre of land is to belong to my wife Elizabeth Laub for her to live. If this isn't enough to build the required home, "then a proportional sum of each of my surviving children's legacy shall be kept back to pay for the balance for the building". The sums willed to the surviving children are to be paid to them as they come of age. Should any of them die before they become of age, then their share to be divided among the surviving children. "I will a bed and a bedstead to my wife Elizabeth Laub, and a bed and bedstead to my daughter Catharina [sic] Schwartz, and a bed and bedstead to my daughter Susanna Schwartz." Remainder of loose property after debts are paid is to remain for the use of his wife, Elizabeth Laub. "If my wife, Elizabeth Laub should die or if she should marry again after my death, then that frame house with the one acre of land is to be sold and the amount equally divided among the surviving children that she has begotten from me. Also, I will that as long as my wife Elizabeth Laub shall remain in my house and premises, she shall not harbor any strangers, nor shall she take any person into the house to live with her, but only my surviving children, also that she take good care of my house and all the premises."

    Codicill dated 11 Dec 1852:
"I [Henry Schwartz] have forgotten to will to my wife Elizabeth Laub several articles. She is to have a cow, two pigs, the cupboards, the large sugar kettle and a cooking kettle, also a tea kettle, the spinning wheel and the reel, a ton of hay, also all the hens that are on the place, five chairs, a table and two benches, the cradle for infants and 200 lbs of pork, also my will is that my son John Schwartz is to have the stove that is on my premises. My son Philip Schwartz is to have all my carpentor tools." Witnessed by Conrad Zoegner and J. Frederick Metzger.
