A-2-34 John Diller Be it known that on the twenty seventh day of July in the year of our Lord one thousand eight hundred and fifty nine that Last Will and Testament with codicil of John Diller, late of the Township of Amhurst in the County of Erie, in the State of New York, one of the United States of America, Gentleman, who died on or about the fourth day of June 1859 at the Township of Amhurst in the said County of Erie and had no fixed place of abode in Upper Canada but had at such time real and personal estate in said county of Waterloo, was proved and registered in the said Surrogate Court a true copy of which said Last Will and Testament and codicil are hereunder written and that the administration of all and singular the personal estate and effect…was granted to Moses Springer of the Village of waterloo, Esquire and Elias Snider of the Township of Waterloo, Yeoman, the Executors named in said Will and Codicil….

I John Diller of the Township of Waterloo in the County of Waterloo, Yeoman…do make and publish this my Last Will and Testament…I will and desire that all my just debts testamentary and funeral expenses be paid by my hereinafter named Executors as soon as conveniently can be after my decease and as to my wordly[sic] estate wherewith it hath pleased God to bless me, I give and dispose of the same as follows :

2. It is my will that my hereinafter named Executors shall find and provide all suitable necessaries for my beloved wife Anne during her natural life and see that she is well taken care of and pay the same out of my estate : My will further is that after the decease of my beloved wife and my herein after named Executors have paid all my debts, they shall divide the whole of my property in four parts and the children of my deceased daughter Veronica shall have one part, and my son-in-law John Moyer the husband of my daughter Nancy shall have the second part, and the children of my deceased daughter Catharine shall have the third part and my daughter Judith shall have the fourth part as hereinafter mentioned :

4. Further I will unto my daughter Judith as a special Legacy out of my estate the sum of twelve pounds ten shillings of lawful money to be paid to her and not to her husband by my herein after named Executors ; and I also will that my said daughter Judith shall have at the appraisement of my real property the four acres of land on the south side of the public road, and on the west side of my land whereon Abraham Diller built a small house being part of Lot Number six of the German Company Tract in the said Township of Waterloo. My said daughter Judith shall have the liberty to take at the appraisement, which is to be appraised by itself and she shall hold the same during her natural life and after her decease my Executors hereinafter named shall sell the same and divide the proceeds thereof equally among her children and whatever my daughter Judith's fourth share amounts to more than what the said four acres are appraised at, my herein named Executors shall keep in their hands and give the interest yearly thereof to my daughter Judith, and after her decease, divide the same equally among her children and that the husband of my daughter Judith shall have nothing to do with or say to her fourth share he is only to have the liberty to dwell with her in the house during her natural life.

5: It is my will that my grand daughter Catherine Wissler (now Catherine Kaufmann) shall not draw her respective share with the remainder of my grand children, her share shall remain in the hands of my herein named Executors during her natural life, and pay to her the interest thereof yearly and not to her husband and after her decease divide the same equally among her children.

6: And my will further is that none of my grand children or great grand children shall draw their respective shares before they obtain the age of twenty one years unless my herein named Executors see fit to pay them sooner and

7: I nominate and appoint my trusty and worthy friends Elias Snider of the Township of Waterloo, Yeoman, and Moses Springer of the same place, Merchant, to be the Executors of this my Last Will and Testament…

Codicil: I, the undersigned do hereby state to my Executors named in the above will that I have already paid to my son-in-law John Moyer one hundred dollars and to my deceased daughter Catherine Bowman three hundred and eighty three dollars, and to my daughter Judith Diller two hundred dollars, one hundred dollars of which I gave in land and the other hundred my agent Daniel Snider gave her, all of which is to be deducted out of their respective shares at the time when a final settlement is made of my estate. Dated this eighteenth day of February 1857.
