    Johann Niergarth The Last Will and Testament of Johann Niergarth, late of the Township of Woolwich, Butcher, who died on or about the thirty first day of January 1863 at the Township of Woolwich, aforesaid, and who at the time of his death had a fixed place of abode at Woolwich, was proved and registered in the said Surrogate Court, a true copy and translation of which said last Will and Testament is hereunder written and that the administration of all and singular the personal estate and effects, rights and credits of the said deceased, and any way concerning his will was granted by the aforesaid Court to Johannes Lein of the Township of Woolwich, Yeoman, and Jacob Werth of the Township of Woolwich, Minister, the Executors named in the said Will…

    In the name of the Friune God, Amen. As it may be perhaps in my more and more increasing sickness please God to call one from this world, so I Johann Niergarth residing in the County of waterloo, Township Woolwich, have realord[?] this day, the thirtieth January 1863, in the grace of our Lord, possessing sound understanding and full consciouness of mind how it shall be dealt with my estate as well real and personal after my decease and acknowledge this as my Last Will as I have entrusted the Executorship of the same to Johannes Lein and Jacob Werth, residing at the afordsaid County and Township Executors. (First) I resolve that three weeks after my decease all moveable property shall be publicly sold and my debts out of the proceeds thereof. Then in that case my house and Lot shall also be publicly sold as my Executors and the creditors any come to an amicable agreement so I conclude after that, that three children namely Kareline, Seibert, a born Niergarth, Wilhelm Niergarth and Frederick Niergarth, all residing in the United States, shall be achnowledged by a legacy of one dollar each, further my five children living here in Canada, namely Margaretha Reichert, a born Niergarth, Juliane Niergarth, Jacob Niergarth, Wilhelmine Niergarth and Karl Niergarth, as common heirs of my property to be divided in equal shares.
