    Edward E. Dietrich

    Seized with a heart attack while cutting willows at the corner of Peppler and Erb streets, Waterloo, Tuesday afternoon, Edward E. Dietrich, 70, died shortly after. He was removed to his home, 32 Princess street. Mr. Dietrich was born at Dashwood. He was a former employee of the Globe Furniture Company. Deceased attended St. Louis RC church and was a member of the Holy Name Society. Surviving are his wife, a son, Michael of Albany, N.Y., a daughter, Mrs. Thomas Winkler of Waterloo, a brother, Henry Dietrich of St. Clements and four sisters, Miss Mary Dietrich and Mrs. Henry Hergott, both of St. Clements, Mrs. David Kuntz and Mrs. Alex Stumpf of Waterloo. The funeral will be held at St. Louis RC church, Waterloo, Friday morning at 9 o'clock. Burial will be made at Waterloo Mount Hope Cemetery.

    MATHIES DAUB - The death occurred at the residence of Mr. L. Wellheuser, Waterloo street this morning of his father-in-law, Mr. Mathies Daub, in his 88th year. The deceased was born in St. Clements but lived in Kitchener for the past 3 years. He was predeceased by his wife and one daughter, 21 years ago. Mr. Daub was in his usual good health until two weeks ago when he fell and fractured a hip from the results of which he failed to recover. He is survived by five sons, John of Champion Alta., Peter of Blackie, Alta., Joseph, Benton, Alta., Lawrence and Fred of Kitchener and by four daughters, Mrs. J. Muckenhirn of Calgary, Mrs. Ed. Dietrich, Waterloo, Mrs. J. Ludwig and Mrs. L. Wellheuser both of Kitchener and by 22 grandchildren and five great grandchildren. The funeral will be held from the above address on Wednesday morning at ten o'clock to St. Mary's church. Interment will be made in Mount Hope cemetery.

    Christoph Daub The Last Will and Testament of Christoph Daub late of the Township of Wellesley, Yeoman, who died on or about the fourteenth day of January 1863 at the Township of Wellesley, and who at the time of his death had a fixed place of abode at Wellesley, was proved and registered in the said Surrogate Court a true copy of which said Last Will and Testament is hereunder written, and that the administration of all and singular the personal estate and effects, rights and credits of the said deceased, and any way concerning his Will was granted by the aforesaid Court to Ambrose Starr and George Meyer, both of the Township of Wellesley, Yeomen, the Executors named in the said Will…

    This is the Last Will and Testament of Christoph Daub of the Township of Wellesley, Yeoman, who being of sound and disposing mind, memory and understanding does will as following, viz : -

    (Firstly) I will and devise that my just debts and funeral charges be paid by my Executors as soon as conveniently may be after my decease.

    (Secondly) I give bequeath and devise unto my beloved wife Juditha Daub the use of my dwelling house and the use of the garden adjoining the same during the time of her natural live[sic]. Also, all the household furniture which may be in my said dwelling house at the time of my decease, also one third part of all the produce raised on my farm being Lot Number Nine in the Nineth concession of Township of Wellesley East Section during the time of her natural life to be delivered to her in the barn upon said land ready for market ; also sufficient fuel for her own use to be delivered to her when needed and at the door of the house in which she may dwell on my said farm : also one cow and two sheep and stabling good pasture and sufficient food for said cow and two sheep ; also each and every successive year one hog weighing about two hundred pounds.

    (Thirdly) I give all my real and personal estate unto my Executors hereinafter named in trust to dispose of the same as follows, viz :

    (Fourthly) I give, bequeath and devise unto my son Wendel Daub my farm being Lot Number Nine in the Ninth concession of Township of Wellesley, Eastern Section, containing by admeasurement one hundred acres more or less, also one thrashing machine, one wagon, one plough, one harrow, also two horses, one cow and two hogs, which he is at liberty to choose and select himself or his heirs or assigns of and out of my stock within a reasonable time after my decease, subject to the following conditions, that is to say :

    (First). That he does deliver or cause to be delivered to my beloved wife Juditha Daub, his mother, at the first of January of each and every successive year from the time of my decease during the time of her natural life, one third part of all produce raised on said farm to be delivered to her at the barn aforesaid, promised ready for market.

    (Secondly) That he does deliver or cause to be delivered to her a sufficient quantity of fuel for her own use prepared for the stove to be delivered to her when needed and at the door of the house in which she may dwell on said premises.

    (Thirdly) That he does furnish her each and every successive year with one well fed hog weighing about two hundred pounds or more.

    (Fourthly) That he does find her stabling, good pasture and sufficient other suitable food for one cow and two sheep. And Lastley that he does pay or cause to be paid unto my Executors hereinafter named in trust (to be disposed of as herein after named) the sum of one thousand eight hundred dollars lawful money of Canada, in ten equal successive annual payments of one hundred and eighty dollars each with out interest first payment to be paid and to be due and payable at the expiration of three years after he my said son Wendel Daub has received possession of said farm.

    (Fifthly) I give, bequeath and devise unto each of my three sons, Casper Daub, Joseph Daub and Mathias Daub, the sum of six hundred dollars payable by my Executors to them, their executors or assigns in equal proportions det[?] of annual payments of the money to be made by my son Wendel Daub as more fully appears in the conditions named Lastly of the fourth clause of this my Last Will and Testament.

    (Sixthly) I give bequeath and devise unto my son-in-law Joseph Linsemann, late husband of my daughter Maria Linsemann, deceased, the sum of two hundred and nine dollars and seventy five cents, lawful money which amount he has received from me according to a note of his hand in my favour and in my possession dated December the first 1856, which said note is to be delivered to him by any Executors directly after my decease in lieu of the sum bequeathed to him aforesaid.

    (Seventhly) I give, bequeath and devise unto my daughter Gertrude Hoffert, formerly Gertrude Daub and her husband Joseph Hoffert, the sum of one hundred and thirty six dollars and eighty cents (say $136.80¢) which amount I paid for a suit entered by one Henry Finch in the Court of Quarter Sessions held in and for the County of Waterloo on the twentyth day of September 1858 against said Joseph Hoffert.

    (Eighthly) I give, bequeath and devise unto Caroline Bauer, illegitimate child of my daughter Gertrude Hoffert, formerly Gertrude Daub, now wife of Joseph Hoffert, the sum of seventy three dollars and twenty cents payable to said Caroline Bauer by my Executors as soon as conveniently may be after my and my wife's decease.

    (Ninethly) I give, bequeath and devise unto the six children of my daughter Maria Linsaman, deceased, late wife of Joseph Linsemann named, George Linsemann, Simon Linsemann, Joseph Linsemann, John Linsemann, Anna Linsemann and Maria Linsemann, the sum of fifty dollars to be divided equally amongst them, share and share alike or amongst those of the said six children surviving at the time of payment of aforesaid sum of $50, which will be as soon as conveniently may be after my and my wife's decease.

    (Tenthly) My will is that my Executors as soon after my decease as conveniently may be, do collect all my personal property not disposed off[sic] in the foregoing Clauses of this my Last Will and Testament and sell the same to the best advantage with by private sale or public auction and pay with the proceeds of such sale all my just debts and bequeath if any overplus & divide the same in equal proportions amongst three of my children, namely Casper Daub, Joseph Daub and Mathias Daub, share and share alike.

    (Eleventhly) I empower and authorize my Executors hereinafter mentioned, to ggrant a Deed or Deed of conveyance in fee simple to any person or persons of any or all my real estate as I myself might or could do where[sic] I living.

    (Twenfthly) I hereby authorize my Executors to reimburse themselves for all expenses and loss of time which they might have or may be subject to in executing this my Last Will and testament. (Lastly) I nominate and appoint Ambrose Starr and George Meyer, both of the Township of Wellesley, Yeomen, as my Executors, hereby revoking all former will by me at any time heretofore made…
