    Rudolph Litwiller of New Hamburg died yesterday at St. Mary's Hospital, Kitchener after a lengthy illness at the age of 56 years. The late Mr. Litwiller was born at Wellesley, November 7, 1904, a son of the late Mr. and Mrs. Christian Litwiller, and had resided in New Hamburg for the past 25 years. He had been employed by the Municipal Spraying and Oiling Company. The late Mr. Litwiller is survived by his wife, the former Agnes House, whom he married in 1925 at Buffalo; two sons, James of New Hamburg and Jerome of Calgary; a brother, John, of Lancaster, N.Y. and a sister, Mrs. Milton (Leah) Leis of Kitchener. The body will be at the Futher-Omand Funeral Home after noon today, until removal will be made to Steinman Mennonite Church Saturday noon for service at two p.m. Bishop Orland Gingerich and Rev. Elmer Schwartzentruber will officiate.

    FINED $25 FOR FAILING TO STOP AFTER ACCIDENT

    In the Kitchener police court on Thursday last, Ruddy Litwiller, Glasgow Lane, Kitchener, was found guilty of failing to return to the scene of an accident after hitting a horse and buggy and was fined $25 and costs or 19 days in jail. Although Litwiller produced eight witnesses to support his claim that he was not out of the house at the time of the accident, the prosecution produced a bill for gasoline which Litwiller purchased at a local gasoline station, the clerk at the gasoline station swearing that he sold several gallons of gas to Litwiller on the night of the accident. Litwiller claimed to have bought no gas on Dec. 24th but on Dec. 23rd, the night before the accident. The magistrate said he believed the witnesses who gave evidence on behalf of Litwiller were mistaken and he accordingly imposed the above fine, the witnesses also disagreeing in their evidence to some extent. Litwiller asked for an adjournment until Wednesday as he wished to enter an appeal, which was granted.

    Death of Christian Litwiller

    Death came very suddenly to an esteemed resident of New Hamburg late on Monday evening, when Mr. Christian R. Litwiller passed away at the home of his daughter, Mrs. Milton Leis, near Mannheim. Mr. Litwiller had been working at Wellesley during the day and went to his daughter's home for the night. He had his supper and retired about 10 o'clock apparently in his usual robust health but shortly thereafter was seized with a heart attack and passed away before medical aid could be summoned. The deceased was born near St. Agatha and spent his whole life in this community. For the past twelve years he was a resident of this town. He was aged 56 years, 9 months and 13 days. He leaves his wife, who before her marriage was Katharine Kropf of St. Agatha, besides his daughter, Mrs. Leis and four sons, Edward of New Hamburg, Ivan of Hamilton, and Rudy and John of Lancaster, N.Y. He is also survived by one brother, John Litwiller of Wilmot, and two sisters, Mrs. Aaron Wagler, of Baden, and Miss Catharine Litwiller, of St. Agatha. The funeral was held from his late home here yesterday forenoon with service in the Amish-Mennonite Church, near Baden, followed by interment in the A.-M. Cemetery. The funeral service was conducted by Bishop Daniel Steinman and was attended by a large circle of relatives and friends.

    Mrs. Catharine Litwiller, widow of the late Christian Litwiller, died at the home of her son, Rudy, Queen street, on Wednesday, at the age of 82 years. The deceased was born in Baden, a daughter of the late Mr. and Mrs. Joel Kropf, and had lived with her son here for the past four years. Her husband predeceased her in 1931. Mrs. Litwiller, who was a member of Steinman A. M. Church, is survived by two sons, Rudolph, of New Hamburg, and John, Lancaster, N.Y., and one daughter, Mrs. Milton (Leah) Leis of Kitchener; a brother, John, and a sister, Mattie, of Wellesley, and 24 grandchildren and 35 great-grandchildren. Three sons, four brothers, and three sisters predeceased her. The body will be at the Futher-Omand funeral home until Saturday noon when removal will be made to Steinman Church for memorial service at 3: 00 p.m. Internment will be in the church cemetery. In charge of the services will be Bishop Orland Gingerich.

    Fatal Accident

    Mr. Litwiller, a farmer near St. Agatha, died on Sunday last from injuries received in that village a day or two before, when he fell from a stairway, breaking several ribs and perforating his lungs. He was a very highly respected resident.

    Litwiller, Peter (1809-1878)

    Peter Litwiller was born 8 January 1809, in Illfurth, Upper Alsace. His parents were Anna Maria (the name she went by) Maurer and Jacob Litwiller. Jacob died in 1814. Widow Maria, three married daughters and their families, two single daughters and Peter left France and arrived in New York on 12 July 1827.

    On their arrival in Waterloo, they selected lots in the newly-surveyed centre block in Wilmot Township and set to work. Young Peter selected Lot 7, on the north side of Erb's Road, but did little work on his own lot until after his marriage to Elizabeth Lichti in 1830. By 1835, however, he had completed his settlement duties and received his patent for the front fifty acres from the Crown.

    In 1838 Peter bought a little notebook which he called his "Notizbuch." It illustrates the settlers' system of bartering goods and services. Litwiller frequently hired persons by the day or to do certain tasks. This may have been the labourer's only way to get a little needed cash as much as Litwiller's need for assistance. Goods supplied in exchange for work might be yarn for stockings, material for a coat, a pound of "dubock" (tobacco), or postage for a letter. A study of the names appearing in Litwiller's notebook is a veritable "who's who" of new Amish-Mennonite arrivals in Canada. Litwiller also had dealings with his non-Amish neighbours, most of whom were Roman Catholic.

    Peter's compassionate business acumen won for himself the respect of his co-religionists and, at the age of 28, he was chosen for the ministry in the Wilmot Amish Mennonite congregation in 1845. That was also the year that he served as one of the trustees who purchased the school site which the Amish had established at the site of the present St. Agatha Mennonite Church.

    Peter's brother-in-law, Rudolph Roth, a gifted preacher, had been ordained minister in 1835 and bishop in 1843. Family relationships during the next few years must have been very trying for Peter and his sisters and in-laws when Rudolph Roth, his wife Maria (nee Litwiller), Jacob and Barbara (Litwiller) Gardner, and Veronica (Litwiller) Gingerich (but not her husband) joined the Reformed Mennonites . Rudolph's early demise in 1853 removed him from any conflict which Peter might have had with him.

    Rudolph's leaving the Amish-Mennonite fold and the deaths of both Bishop John Oesch in Hay and Bishop Christian Miller in Wilmot, left the aged Bishop Christian Wagler, recent immigrant from Alsace, as the only bishop for the whole Amish-Mennonite constituency. It must have been Bishop Wagler who ordained Peter Litwiller that same year, and after Wagler's death the following year, Peter was left with bishop oversight over the whole Amish-Mennonite community from Wilmot to Lake Huron.

    Joseph Ruby was ordained bishop for the South Easthope-East Zorra congregation in 1853 and John Jantzi for the North Wilmot-Wellesley congregation in 1859. The Hay congregation, however, did not ordain a bishop, and were served by those in East Zorra or Wilmot for the next 100 years.

    Peter Litwiller's farm buildings were across the street and up the road a short distance from the Catholic Church. In 1857, a dedicated young man by the name of Eugene Funcken arrived in St. Agatha to serve in the Congregation of the Resurrection. Father Funcken was full of zeal and energy. These two men might have had good reasons to ignore each other, at best, or engage in a running feud, at worst, but they did neither. According to family tradition, they met with each other regularly to discuss topics of a religious nature. They set the stage for a peaceful community, rather than one where various factions are in conflict.

    Peter Litwiller died 7 July 1878. It is said that when the funeral cortege passed the Catholic church on its way to the Amish cemetery, Father Funcken had the bells tolled. A broadside printed at the time of his death is also attributed to Father Funcken. In it he extolled the bishop's character and his ministry.1

    LITZWILER.-July 8th, of long suffering with rheumatism, PETER LITZWILER, bishop of the Amish Mennonite church, at the age of 69 years, 5 months and 27 days. He was beloved by all who knew him.

    , Probate of the Will of Henry Kropf, late of the Township of Wilmot, granted the Twenty Eighth day of November 1855, on the petition of David Kropf and John Gasho, the Executors named in said Will.

    I Henry Kropf of the Township of Wilmot, Yeoman, being sick and weak of body…My Will is that my just debts and funeral charges shall by my Executors hereinafter named, be paid out of my Estate….My will is that my beloved wife [unnamed] Kropf and family, shall continue to farm my farm, situated on Lot number fourteen, south of Erb's road in the Township of Wilmot, where I now reside, until that my eldest son become to be the age of Twenty one years (or so long as she shall continue to be sole) and in case of her death or marriage before my eldest son become of age, then my said farm shall be let by my said Executors, until my eldest son become of age…and when my eldest son arrive at the age of Twenty one years, then my said farm shall be appraised by six impartial neighbors, chosen by my Executors for that purpose, and then if my said wife can give to my eldest son, his share of his legacy after the appraisement being so made, then my said wife may continue to farm the said farm, until my second son become of age, and so on till the youngest of my sons becomes of age, always paying them their share as they become of age…but if she cannot so pay my eldest son his share or legacy, then my eldest son may and shall have my said farm (if he so chose) to himself, by paying over the other heirs at law and my said wife equal shares according to the appraisement made, and if the eldest son do not so like the said farm, then my second son to have the same chance as the eldest son hath in taking said farm, and so on to the youngest of my sons, and if neither of my sons will take the said farm, then shall the same be sold and the proceeds thereof to be equally divided amongst my said wife and children, as shall then be living, share and share alike, and so soon as one of the other of my sons shall so take the said farm, then shall my Executors hereinafter named build a house for my said wife, 24 by 23 feet in size, and put up a Stable for her at the expense of my Estate, and take out two acres of land for her on my farm where ever my Executors may select to have and to hold the same to her, for and during her natural life; And also in case of my said wife's death or marriage, or in case of one or the other of my sons taking my said farm, then I will that my personal property, to be sold and divided share and share alike amongst my said wife and children then living; And the share of my Real and Personal Estate thus, bequeathed to my Beloved Wife [unnamed] Kropf to be in lieu of her Dower at Common Law, if she shall so elect. Provided always that if one of the other of my children do not obey or give hearing to my said wife, or Executors after her death, in all cases whatever, that child or children shall only be entitled to one half of a share of the share coming to him or her, till he or she give hearing or obeying, as aforesaid, then to have his or her full share, but only in case of obeying as aforesaid, and in case that they don't obey then the said one half share to be divided equally amongst my said wife and children And also, I do direct and my Will is, and I do appoint that my said dear Wife shall have the Guardianship and tuition of my children, which I shall leave at the time of my decease, during their minority, so long as she shall continue to be sole; and in case of her death or marriage, during the minority of such my children, then I will and appoint that my Brother David Kropf shall have the tuition and Guardianship of them, during such their minority; and in case of his refusal or decease, I will that my other Executor, John Gasho, shall exercise the said Guardianship. And earnestly entreat their utmost care, respectively, in and about the morals and education of my children, such as may survive me, and desire that they may be brought up and instructed in the doctrines and religion of the Mennonite Association. And I do nominate and appoint my Brother David Kropf and my much esteemed friend John Gasho to be the Executors of this my Last Will and Testament.
