    A-2-136 William Martinson The Last Will and Testament of William Martinson late of the Township of Wellesley, Yeoman, who died on or about the 5th day of March 1862 at the Township of Wellesley, and who at the time of his death had a fixed place of abode at the Township of Wellesley, was proved and registered in the said Surrogate Court a true copy of which said Last Will and Testament is hereunder written and that the administration of all and singular the personal estate and effects…of said deceased, was granted to John Martinson of the Township of Wellesley, Yeoman, William Fowler of the Township of Wellesley, Yeoman and Michael Peter Empey of the Township of Wellesley, Merchant, the Executors named in the said will…

    …I William Martinson of the Township of Wellesley, Yeoman, of the age of fifty six years, and being of sound mind and memory do make, publish and declare this my Last Will and Testament in manner following to wit : My will is that my funeral charges and just debts shall be paid by my Executors hereinafter named. The residue of my estate and property which shall not be required for the payment of my just debts funeral charges and the expenses attending the Execution of this my Will and the administration of my estate, I give, devise and dispose thereof as follows, that is to say :

    (First) I give and bequeath to my Nephew William Martinson, son of my brother John Martinson, the following lands, namely the north half of Lot Number Two in the fourteenth concession eastern section of Wellesley, containing about ninety one acres,. The east part of the north half of Lot Number Three in the fourteenth concession east section Wellesley being bounded on the north by allowance for concession road, on the east by allowance for side road and on the south west by Conestoga river, containing about thirty three acres - part of the north part of Lot Number Nineteen in the fourteen concession, western section of Wellesley being particularly mentioned and described in a deed of conveyance made by John Martinson and his wife Margaret Martinson to myself bearing date the third day February one thought eight [sic] sixty two, consisting of twenty five acres more or less. I am possessed of certain promisory notes which with the interest now accrued on them are worth about one thousand nine hundred dollars out of this chattel I also give and bequeath to my said Nephew William Martinson one thousand two hundred dollars to be paid to him in three equal payments of four hundred dollars each. The first payment of four hundred dollars to be made to him in two years from this date with lawful interest. The second payment of four hundred dollars in three years with interest from this date. The third and last payment of four hundred dollars in four years with interest from the present date. The above gifts and bequests are given and made to my said Nephew William Martinson on the condition that he shall pay or cause to be paid, First, the sum of four hundred dollars to my Nephew Richard M. Quickfall, son of Thomas Quickfall of Waterloo, within two years after my death as a legacy from me.

    Secondly, the sum of two hundred dollars to my niece Mary Ann Quickfall, daughter of Thomas Quickfall, three years after my death.

    Thirdly, the sum of one thousand dollars to Maretta Martinson, daughter of my brother John Martinson in two equal payments of five hundred dollars each, the first payment one year after she comes of age, making in all the sum of one thousand nine hundred dollars to be paid by my said Nephew William Martinson as legacies on my behalf out of the gifts and bequests made by me to him as aforesaid or on the condition of such gifts and bequests.

    Second - I give and devise to my brother John Martinson fifty acres of land consisting of the south half of the east half of Lot Number Nineteen, in the fourteenth concession western section. And I also give and bequeath to my brother John Martinson all the residue of my personal estate and effects of what nature or kind soever consisiting principally in promissory notes after all debts charges and expenses against my estate are discharged. The said several gifts and bequests are given to my said beloved brother John Martinson on condition that he shall pay to my said beloved niece Marietta Martinson five hundred dollars that is two hundred and fifty dollars when she shall come of age and four hundred and fifty dollars one year after she shall come of age and I also devise that my said beloved brother John Martinson shall pay to his wife Margaret Martinson, as a gift from me, twenty dollars at each time as may best suit his convenience and he shall pay as gifts from me to James Brown, Samuel Brown, Jane Brown, Mary Ann Woodward, Charles Brown and David Brown, children of my said brother John Martinson's wife, each the sum of twenty dollars when they shall severally come of age or sooner if it shall suit hisw convenience to do so. Should either of the Quickfalls or Browns die before receiving the bequests mentioned herein to be paid them, such bequests or gifts to remain in the hands of the party who was required to pay the same as his own property. The Executors hereinafter named are hereby authorized and empowered in order that they may be enabled fully and effectually to carry out and properly administer the terms and conditions of this my Last Will and Testament, to execute bonds, deeds, memorials, conveyances, releases or discharges or whatsoever may be legally or lawfully required for perfecting and closing up the affairs of my estate. And I nominate and appoint my beloved brother John Martinson, William Fowler of Wellesley, Yeoman, my respected neighbour - and Michael Peter Empey of Wellesley, Merchant, to be the Executors of this my Last Will and Testament…
