    Notes:

    The men who took the most prominent part in organizing the first library in the village were: Rev. Dr. Bayne, Alexander Burnet, James Cowan, John Gowinlock, William Trotter, H. G. Barlow, James Harris, Andrew Elliott, Francis McElroy, Francis Hogg, Andrew Moscrip and Walter H. Benn. These men have long since passed away, but they all did good work in their day in laying the foundations of a progressive and moral community; to the older generation of Galtonians their names call up a crowd of memories of the days that are no more.

    Notes:

    In the death of Mrs. Andrew Moscrip at an early hour this morning, Galt loses one of its oldest and most highly respected residents. For 62 years was the deceased a resident of Galt. living all that time on the farm at the end of Samuelson street. She was widely known both in Galt and throughout the county, and hundreds of friends will regret to learn of her death. She was 89 years of age. The deceased's maiden name was Joanna Oliver, and she was born in Sutherlandshire, Scotland, in 1821, coming to Canada in 1840. For some years she lived in the Province of Quebec, coming to Galt in 1848. In 1850 she was married to the late Andrew Moscrip, taking up her residence on the farm where she lived continuously until her death. Mrs. Moscrip was a member of the First Presbyterian church, in the welfare of which denomination she took a deep interest. Coming to Galt at a time when the population was only about 1,000, the deceased watched the then small village grow to its present large proportions and took much pleasure in telling her friends of the early days in Galt. Possessed of a Christian spirit and a kindly manner, the deceased made for herself hundreds of warm friends and the news of her death will cause heartfelt regret in many homes. Surviving are three daughters, Mrs. J. S. Johnson, South Water street; Miss Moscrip and Mrs. Rothwell, at home. The eldest daughter died in 1902. The deceased was the last sister of a large family. Two brothers, Adam Oliver of Branchton, and Andrew Oliver of Missouri, survive, and also four grandchildren. The funeral will take place from the deceased's large residence, Samuelson street, on Wednesday afternoon at 2.30 o'clock, to Mount View cemetery.

    "For the trek from Hamilton to Galt vicinity they secured a wagon of some kind, and, I suppose a horse, so that the women of the family might ride. The men and boys took turns walking. It must have been harvest time for as they approached their goal they stopped to help thresh grain with flails at various farm holdings and in this way earned one bushel of grain for each ten bushels they threshed. By doing this they procured enough grain to seed the cleared section of the 160 acres which they bought from a Mr. Monroe situated about four miles from what was to become the City of Galt. This farm became the Oliver Homestead and remained in the Oliver Family until 1959."

    Last Will & Testament of Robert Oliver the Elder late of North Dumfries Died 28th March AD. 1863

    In Her Majesty's Surrogate Court of the County of Waterloo Be it known that on the first day of December in the year of our Lord one thousand Eight hundred and Sixty three the last will and Testament of Robert Oliver the Elder late of the Township of North Dumfries in the County of Waterloo, Yeoman who died on or about the Twenty Eighth day of March in the year of our Lord one thousand Eight hundred and Sixty three, at the Township of North Dumfries aforesaid and who at the time of his death had a fixed place of abode at North Dumfries in the said county of Waterloo was proved and registered in the said Surrogate Court, as true copy of which said last Will and Testament is hereunder written, and that the administration of all and singular the personal estate and effects, rights and credits of the said deceased, and any way concerning his Will, was granted by the aforesaid Court to Andrew Moscript of the Township of North Dumfries in the County of Waterloo yeoman, David Harvie of the same place yeoman and Thomas Oliver of the Township of Beverly in the County of Wentworth House Framer the Executors named in the said Will, they having been first sworn wll and faithfully to administer the same by paying the just debts of the deceased and the legacies contained in his will, so far as they are thereunto bound by law and to exhibit a true and perfect Inventory of all and singular the said Estate and effects, rights and credits, and to render a just and true account of their Executorship whenever required by law so to do (signed) A.J. Amen - I Robert Oliver the Elder, of the Township of North Dumfries, in the County of Waterloo and Province of Canada - yeoman, being of sound and disposing mind, memory and understanding do make publish and declare this to be my Last Will and Testament hereby revoking and making null and void all former last Wills and Testaments and writings in the nature of Lasts Wills and Testaments by me here of one made (signed) (Robert Oliver) Whereas Whereas - under and virtue of a certain Indenture bearing date the twentieth day of June, in the year of our Lord, One thousand eight hundred and Fifty five and made between Adam Marshall Oliver of the Township of North Dumfries in the County of Waterloo and Province of Canada Yeoman, of the first part, and me the undersigned Robert Oliver the Elder, of the same Township, County and Province Yeoman of the Second part, and Isabella Oliver, wife of me the said Robert Oliver, of the third part, it was witnessed, that for and in consideration of Seven hundred and fifty pounds of lawful money of Canada by me the said Robert Oliver in hand well and fully paid at the sealing and delivery of thos presents, the receipt whereof is thereby acknowledged, he the said Adam Marshall Oliver had granted Bargained, sold, aliened and released, and by those presents did grant, bargain sell, Alien, release and confirm unto me the said Robert Oliver my heirs and Assigns, all and singular that parcel or tract of land and premises, situate lying and being in the Township of North Dumfries in the County of Waterloo, and Province of Canada containing by admeasurement One hundred and Sixty Acres be the same more or less, being composed of the north half of Lot number Five and the North proportion of Lot number Six in the Eighth Concession of the said Township of North Dumfries and is butted and bounded or may be otherwise known as follows, that is to say: Commencing at the distance of forty chains from the South east angle of Lot number five in a course from said angle North 15.40 (degrees) West - thense continuing the same course 15.40 (degrees) west forty chains more or less to the allowance for highway between the eighth and ninth concessions - then along said concession allowance South 16.30 (degrees) West fifty chains more or less to a side Road Allowance between lots number Six and Seven thence on the said Side Road Allowance South 15.40 (degrees) East twenty four chains more or less to John Shiels north boundary - thence along said boundary north of 6.30 (degrees) East Sixteen chains more or less to the limit of lot number five thence South 15.40 (degrees) East Sixteen chains more or less to the North Easterly boundary of Hugh Arthurs Lot - Tence North Seventy six degrees thirty minutes east twenty five chains more or less across the center of the whole lot number Five to the place of beginning ---------------- To have and to hold - the said Lands, tenements, hereditaments and premises therein before described with the appurhnanes unto me the said Robert Oliver my heirs and assigns forever, which said last mentioned Indenture was made subject never the less to the Proviso condition or agreement for redemption of the said premises therein contained that is to say - the said last mentioned Indenture contained a Proviso and those Presents were upon the express condition that if the said Adam Marshall Oliver, his heirs Executors, administraitors or assigns did and should well and truly pay or cause to be paid unto me the said Robert Oliver and Isabella my wife or to one of us during our joint lives and after the decease of one of us, then to the survivor of us, during his or her natural life, the annuity or yearly sum of seventy five Pounds of Lawful money of Canada free and clear of all deductions and abatements whatsoever the first payment thereof to begin and be made on the twentieth day of June in the year of our Lord, One thousand Eight hundred and fifty six - and to be payable on the twentieth day of June in every year thereafter ------- And Also - by which said last mentioned Indenture the said Adam Marshall Oliver, his heirs, Executors, Administrators or assigns were within the space of time therein mentioned, to erect and put up on the said Land a certain dwelling house for me and my said wife and the Survivor of us and were to provide and furnish me and my said wife and the survivor of us with firewood and further that after the decease of the survivor of us the said Adam Marshall Oliver his heirs, Executors, or administrators should well and truly pay or cause to be paid the sum of Seven hundred and fifty pounds of lawful money of Canada as therein mentioned that is to say -------- the the sum of Three hundred and Seventy five pounds at the termination of one year after the decease of the survivor of us, and the like sum of Three hundred and Seventy five pounds at the expiration of Two years - thereafter to such person or persons, and in such amounts or sums as I the said Robert Oliver by my last Will and Testament or any Instrument in writing under and duly attested should order and direct, and in case I the said Robert Oliver should not make any such Will or Instrument then if the said Adam Marshall Oliver his heirs Executors or Administrators did and should pay or cause to be paid the said two several sums of Three hundred and Seventy five Pounds each at the times before mentioned to the administrator or administrators of me the said Robert Oliver for distribution according to law, that ______ and in case of the performance and compliance with those conditions therein before mentioned that the said herein before in part recited Indenture and every matter and thing therein contained should be and become null and void to all intents and purposes whatsoever. -------- By which said last mentioned and in part recited Indenture provision was made for the recovery of the said annuity by distress and the said Adam Marshall Oliver for himself, his heirs Executors and administrators did thereby covenant promise, declare and agree with and to me the said Robert Oliver and Isabella, my wife, and our heirs Executors and Administrators to pay the said several sums of money or Instalments and to do and perform other Pre matters and things. herein before referred to, on the days and times, and in the manner therein set forth - and which said here in before - and last mentioned in part recited Indenture was registered in the registry office for the said county of Waterloo on the seventeenth day of September A.A. 1856- and contains certain other covenants on the part of the said Adam Marshall Oliver all of which will by reference there to fully appear. ----------- Now know ye - that I the said Robert Oliver the Elder in presence of the powers and Rights reserved by Deed conferred upon me by the said last and herein before in part recited Indenture do hereby Give, Devise and Bequeath unto my hereinafter named Executors and the survivor of them, and the Executors, and Administrators of such Survivor (after paying my just Debts and funeral and Testamentary Expenses if any) the said sum of Seven Hundred and fifty pounds so to be paid by the said Adam Marshall Oliver as agreed by the said last and herein before in part recited Indenture (or so much thereof as may remain after the payment of my just debts and testamentary ex- penses) if any) In Trust to pay and Invest to my children and others hereinafter named at the Times and on the events hereafter mentioned Upon Trust - in the first place to pay thereout of the following sums:

    To the heirs at Law of my late daughter (now deceased) Jessie late the wife of one Brown Allet (formerly Jessie Oliver) by the body of Brown Allet consisting of one boy, and two girls each the sum of Five Pounds, Provincial Currency - to be paid to the boy: at the age of twenty one years and to the girls at the age of Eighteen years respectively if one or all of them shall so long live, and in case of the death of one or all of them before attaining such age or ages severally, the respective sums to be distributed accord to Law Upon trust in the next place to pay to my son George Oliver residing in the Township of North East Hope in the County of Perth, Yeoman the sum of Fifty Pounds Provincial Currency

    To my daughter Isabella now the wife of one Thomas Rae (formerly Isabella Oliver residing in Scotland, part of the United Kingdom of Great Britain and Ireland, the sum of Fifty Pounds Provincial currency

    To my daughter Jean, now the wife of one Robert Waugh (formerly Jean Oliver) residing in Scotland part of Great Britain as aforesaid the sum of Fifty Pounds Provincial Currency Upon Trust in the last place to invest the residue of the said sum of Seven Hundred and Fifty Pounds with my said son Adam Marshall Oliver at the rate of Five per cent per annum for the sole and separate benefit of behoff of my son Walter Oliver residing in the said Township of North Dumfries labourer which residue will in case I die free from debt and there are no funeral and testamentary expenses to pay for me amount to the sum of Five hundred and forty pounds - If on the other hand I should die leaving any just debt and there are any funeral or testamentary expenses required to be paid for me the residue left to my said son Walter will then be the said sum of Five hundred and forty pounds less the amount of such just debts and funeral and testamentary expenses, such residue not be invested for any certain period or time but on the contrary such portions of the principal money and interest of such residue are to be meted out, and paid to my said son Walter in such sums or amounts and at such time and times as he may require the same to enable him to live comfortably and happily - - - My reasons for leaving my said son Walter so much more than any of my other children is because of his imbecility and inability to provide for himself - In the event of the death of my said son Walter before any one or all of my said other children - I desire the remaining balance of such residue (if any) to be distributed according to law - - - - - - I hereby nominate and appoint Andrew Moscript of the said Township of North Dumfries Yeoman and David Harvie of the same place yeoman and my said son Thomas Oliver house framer as aforesaid and the survivor of them of them, and the executors or administrators of such survivor. Executors of this my last Will and Testament and hereby empower them or the survivor of them and the Executors or administrators of such survivor upon payments of the said sums of money or upon satisfactory security being given for the payment shares so my said Legatees to execute a good and sufficient Release, or certificate of Discharge of the said last mentioned and hereinbefore in part recited Indenture to the said Adam Marshall Oliver his Heirs, Executors, Administrators or assigns, and to give good and sufficient receipts. - - - In Case my said Executors or the survivor of them or the Executors or administrators of such survivor neglect or refuse to act in the said capacity ____hereby fully empower my said Legatees to take all lawful ways and means for the recovery of their said respective legacies provided always that my said son Walter shall only be at liberty to inforce payment from the said Adam Marshall Oliver, his executors or administrators in such sum as he shall require for his comfortable maintenance, as hereinbefore provided In case of my said executors or the survivor of them or the executors or administrators of such survivor neglecting or refusing to act as aforesaid I fully empower my said Legatees and their legal Representatives to execute a good and sufficient release or certificate of discharge of the said last mentioned and herein before in part recited Indenture to the said Adam Marshall Oliver his heirs Executors, Administrators and assigns - - - - - I further desire and request my said Legatees to agree amicably about how the said first Instalment of Three hundred and seventy five pound (to be paid as aforesaid one year after the decease of me and my said wife Isabella) shall be distributed or apportioned, and will not myself determine whome shall be first paid - In Witness Whereof I the said Robert Oliver the Elder have to this my last Will and Testament contained in ten half sheets of Foolscap paper (including this last sheet) written on one side set my hand and seal, namely to the first nine sheets my hand and to this tenth and last sheet - my hand and seal this Twenty first day of July, in the year of our Lord One thousand Eight hundred and Sixty - - - -
