- A-2-12 Johannes Müller The Last Will and Testament of Johannes Müller, late of the Township of Wilmot, Yeoman, who died on or about the 19th day of December 1858 at the Township of Wilmot, and who at the time of his death had a fixed place of abode at the Township of Wilmot…was proved and registered in the said Surrogate Court a true copy of which said Last Will and testament is hereunder written and that the administration of all and singular the personal estate and effects, rights and credits of the said deceased…was granted by the aforesaid court to George Jutzi and John Brennerman of the Township of Wilmot…
Last Will and Testament of Johannes Müller. It being ordained for all persons once to die, but the time and hour unknown to Waterloo I being of sound mind and memory and positive of this uncertainty have resolved to write down my Testament and Last will and so ordain as follows:-
1: It is my will and I order that all just debts shall be paid and settled at the proper time, but that also at the same time all my outstanding claims whether notes or book accounts, shall be demanded and adjusted.
2: It is my will and I order that my herein named Executors and performers of this my Last Will shall be authorized to sell all which my wife Barbara does not need on advantageous terms; then my Executors shall be authorized when they have my money together of my inheritance and what else remains due to purchase for her fifty acres of land which my wife Barbara shall possess and shall let the same, and she and the children to live of the rent.
3: It is my will and I appoint and declare my aforesaid well beloved wife Barbara Hellmuth as sole and universal inheritress of the whole of the property and effects left by me, of which she shall an undisputed right and use during the whole of her natural life ; well remarked, so long as she live in widowhood and continues to live, but should she at any time after my departure out of this mortality, marry again, then she shall merely have an equal share with my children of the estate left by me, and divide the same in equal shares with them. But if she lives and dies as widow, consequently as universal inheritress of my estate then after her departure all shall fall back to my children who shall inherit the same in equal shares. As Executors of this my Last Will and Testament, I appoint Messrs George Jutzi and John Brennerman….
