      KITCHENER Trevor La Pierre is still appealing his 17-year parole eligibility for the murder of Hunter Brown in 2007. Brown, 74, was delivering Christmas cards to his Kitchener neighbours when La Pierre randomly stabbed him more than 40 times in the head and face with a hunting knife. La Pierre, now 27, received a life term, with parole set at 17 years, after pleading guilty in 2010 to second-degree murder....

      KITCHENER - Trevor LaPierre won't be getting a new trial, despite a psychiatrist's conclusion that the Kitchener man had severe schizophrenia and met the threshold to be found not criminally responsible for murdering Hunter Brown.

      The Ontario Court of Appeal on Thursday dismissed LaPierre's conviction and sentence appeals.

      On the afternoon of Dec. 15, 2007, Brown, 74, was delivering Christmas cards to his neighbours on Glenwood Drive in Kitchener when LaPierre, 22 at the time, attacked him with a large hunting knife.

      Brown was stabbed more than 40 times in the face and head, then left to die while LaPierre casually walked away. He said he killed Brown to please Satan.

      LaPierre at first hoped to be found not criminally responsible of first-degree murder but pleaded guilty to second-degree murder in 2010 after psychiatric assessments found he was feigning or exaggerating signs of mental illness.

      But while in prison, LaPierre got another psychiatric assessment '97 and it found that at the time of the murder, he had severe treatment-resistant schizophrenia that met the threshold to be found not criminally responsible.

      Based on the assessment by Dr. John Bradford, LaPierre appealed his conviction and life sentence.

      In a ruling on Thursday, Justice James MacPherson, writing for a three-judge Appeal Court panel, said he accepts Bradford's conclusion that LaPierre had schizophrenia when he killed Brown. He also accepts there may have been a "casual relationship" between his illness and the killing.

      "However, these two conclusions are not enough to establish that at the material time (LaPierre) was incapable of knowing that his conduct was wrong according to the ordinary moral standards of reasonable members of society," MacPherson said.

      "Dr. Bradford's evidence was, overwhelmingly, directed to (LaPierre's) subjective belief that his conduct was justified and not to his awareness of societal moral standards ... Accordingly, I would not give effect to this ground of appeal. I would not admit the fresh evidence because it could not reasonably be expected to have affected the result at the trial."....

      BROWN, Hunter - It is with deepest sorrow and grief that we announce Hunter's passing, on Saturday, December 15, 2007 at Kitchener, at the age of 74. Beloved husband and best friend of Bev (nee Sparling) Brown for 49 years. Proud and loving father of Sandra Brown of Mississauga and Michael Brown and his wife Beth of Waterloo. Dear Grampa to Lauren and Andrew and Ian. Predeceased by his parents, Hugh and Sadie (nee Hunter) Brown. Hunter will also be sadly missed by his beloved and faithful granddog, Patches, and grandcat, Max. Hugh Hunter Brown was born in Toronto in 1933, the son of Hugh and Sadie Brown. He attended and graduated from Leaside High School, and then went on to attend Victoria College of the University of Toronto for Commerce and Finance. He met his wife, Beverley, at Leaside United Church, playing badminton. After graduating University, he started what would be a lifelong career with the Bell Telephone Company of Canada. He married Beverley in 1958, and had two children, Michael and Sandra. The family lived in Toronto until 1973, when Hunter was transferred to Kitchener to fill a District Manager's position for Bell Canada. Hunter always strived to make his contributions to the communities he lived in. Over the years, he took leadership roles in the executive of the Rotary Club, the KWHSR, Bell Pioneers, and his churches. He always wanted to help out, whether it be canvassing for the Heart and Stroke Foundation, shoveling snow for an elderly neighbour, or helping someone in need as he always put others' needs ahead of his own. In their retirement, Hunter and Bev loved to travel to Barbados and Europe and spend their summers at the cottage, which was the centre of activity and such good times for family and friends. Hunter loved being with his grandchildren; he was involved with, and supported them in everything they did. Hunter was a dedicated and devoted family man. We loved him so very much and were so proud of him. We will dearly miss him. Hunter's family will receive relatives and friends on Thursday, December 20th from 1-3: 30 p.m. and 7-9 p.m. at the Henry Walser Funeral Home , 507 Frederick St., Kitchener, 519-749-8467. Funeral service 1 p.m. on Friday, December 21, 2007 in the chapel of the funeral home followed by a reception at the funeral home. Pastor James Koellner of St. Luke's Lutheran Church officiating. Prayers of committal will take place at Parkview Cemetery Chapel following the reception.
