    • A-2-64 Isaac Mosser The Last Will and Testament and Codicil of Isaac Mosser, Yeoman, late of the Township of Wilmot, who died on or about the 19th March 1860 at the Township of Wilmot, and who at the time of his death had a fixed place of abode at the Township of Wilmot, was proved and registered in the said Surrogate Court, a true copy of which said Last Will and Testament and Codicil are hereunder written and that the Administration of all and singular…of said deceased…was granted by the aforesaid Court to Charles Wing and James Morley of the Township of Wilmot, Yeomen, the executors named in the said Will…

      …I Isaac Mosser of the Township of Wilmot, Yeoman, being of sound mind, memory and understanding do make this my Last Will and Testament…

      (1st) I will and devise unto my beloved wife Catherine Mosser my house and lot in the village of Smithsville and an annuity of forty eight dollars the first to be paid to my said wife three months after my decease to have and to hold the said real estate and annuity so long as she remains unmarried. I further will unto my said wife one bed stead with bed and bedding, a small table with two drawers therein, a trunk which has two locks thereto, my desk with such books in which I have written her name (except the family bible) one spinning wheel and reel, one straw roller, and a cooking stove with furniture and pipe all of which my said wife shall have whether she remains single or marries again, with this exception : If she marries again she shall merely receive an annuity of twenty four dollars instead of forty eight dollars and shall have no claim to my house and lot aforesaid.

      (2nd) I will that the balance of my property shall be sold by my Executors as soon as they conveniently can and pay my just debts and collect the debts due and owing to me.

      (3rd) I will that after the decease of my said wife or so soon as my said wife marries again, my Executors shall sell my said real estate and after investing a sufficient sum the interest of which shall yield a sufficient sum to pay the annuity to my said wife the balance of the proceeds of all my estate (together with the principal invested for said annuity after the death of my said wife) shall be equally divided among my children Margaret, Magdalene, Joseph Catherine, Frederick, and the children of my deceased son John, which children shall inherit their father's portion : had he been still living in equal shares. The husband of my said daughter Margaret shall have no control over her legacy. to have and to hold the above bequests unto my said heirs and to their heirs and assigns for ever. I do hereby nominate, constitute and appoint my sons-in-law Charles Wing and James Morley of the Township of Wilmot Yeomen, Executors of this my Last Will and Testament…

      Codicil: Whereas I, Issac Mosser of the Township of Wilmot, Yeoman, having made and duly executed my Last Will and Testament in writing bearing the date the 8th November 1859 - Now I do hereby declare this present writing to be a Codicil to my said Will and direct the same to be annexed thereto and taken as part thereof. And I do hereby give and bequeath to my said wife Catherine Mosser one cow and my clock, to have and to hold the same to her and to her heirs and assigns forever. And further I do hereby give and bequeath to my son Joseph Mosser the sum of four hundred dollars as a legacy to to paid to him by my said executors out of the first money which come unto my said Executors hand from my estate after paying my just debts. In witness whereof, I the said Isaac Mosser have to this codicil set my hand and seal the 17th February 1860…
