- Woman Heaved Brick Through Window of Beverage Room
Hotel proprietors have a duty to maintain order in beverage rooms, Magistrate A. W. MacMillan said in court as he dismissed two assault charges against Peter Kovarvich, proprietor of the Essex Hotel, Sandwich street west, and found Mrs. Harold Delaney of 464 Janette avenue, guilty of a property damage charge Mrs. Delaney was remanded one week on bail for sentence. Similar charges of property damage against Harold Delaney, Mrs. Ann Belinsky and Elaine Bromaroff were dismissed. The charges and counter charges were laid following a row which started in the ladies' beverage room of the Essex Hotel when the proprietor refused to serve the accused party more beer.
"Mr. Delaney started to fight because I would not let his table have any more beer, and I ordered them out of the hotel. Mrs. Delaney threw a brick through the large glass window in the front door after I shoved her outside," Mr. Karovich testified.
Mrs. Delaney told the court she threw the brick at the proprietor because he was kicking Mrs. Belinsky, her mother.
Defending Mrs. Delaney on the property damage charge, Barney Cohen referred to section 541 of criminal code stating that "under this section it says that any child has the right to protect any parent if they thing the parent is being harmed." Mrs. Belinsky and Mr. Delaney
charged Kovarvich with assault causing bodily harm following the fracas. Mrs. Belinsky showed the court a black eye and bruise marks which she claimed resulted from the proprietor kicking her. Mr. Delaney said that he suffered from three cracked ribs. Both charges were dismissed.
