Today, the 8th May 1854 in the Township of Wellesley in Upper Canada, on the 1st Lot in the 6th Concession, in presence of the witnesses Lewis Hubert and Michael Schneider, both living in Wellesley, I Stephan Waechter, living on the said Lot and paragraph stroked out]
Last Will and Testament of Stephan Waechter, late of the Township of Wellesley, written in German and translated into English and translation verified by C. Enslin, Notary. Today the 8th May 1854 in the Township of Wellesley in Upper Canada, on the 1st Lot in the 6th Concession, In presence of the witnesses Lewis Hubert and Michael Schneider, both living in Wellesley, I Stephan Waechter, living on the said Lot and in the said Concession, possessor of 100 acre land on the aforesaid place, at present yet of good sound understanding and reason do confess and confirm before my last departure, my last Will to execute, in order to avoid all disputes (or differences-translator) after my decease, in case it shall happen so - and have concluded as follows: 1st: In case that I Stephan Waechter do depart life, I empower in virtue of this present will my wife, a born Dorothee Etch[?] all chattels and goods to sell and dispose of by Public Auction, and out of the proceeds thereof to pay debts. 2: The said wife shall have the right after my decease to lease away the said land for 6 years, or to keep herself. 3: The eldest sons shall have the privilege, when able and old enough, to assume and cultivate the land, but if he departs life also, then the second is to have the right, and so forth to the youngest, yet always with the consent of the mother. 4: After the demise of father and mother the land shall be divided in equal portions among the children left, and in case neither of them is able or willing the same to assume to sell it, and the proceeds thereof shall be divided amongst them in equal shares.
