- A-2-14 John Streack Letters of Administration of the estate of John Streak, who died on or about the 30th July 1855 at the Township of Wilmot, and who at the time of his death had a fixed place of abode at the Township of Wilmot, who made and duly executed his Last Will and Testament, and did therein name Anthony Kaiser, Esquire, and Bernhard Doll, Yeoman, of the Township of Wilmot, Executors of his Last Will and Testament, were granted to Magdalena Heimler, of the Township of Wilmot, widow of the said deceased, and a legatee named in the said Will, the Executors having renounced all rights and title to the probate and Execution of the said will….
Last Will and Testament of John Steack…I John Strack, Shoemaker of the Township of Wilmot in St. Agatha, make and ordain this my Last Will and Testament in manner and form as follows, namely :
1st. It is my will and I do hereby order that all my just debts and claims against me shall be paid and all obligations, notes in my possession as also all book accounts which are yet unpaid shall when due be collected.
2nd It is my will that my wife Magdalena, a born Deimert, shall have the third part of all moveable and immovable property which property after my death shall be appraised by my Executors whom I shall appoint.
3rd. It is my will that my wife shall have all the interest of the other two thirds for the education of my children, be she my widow or should she marry again, however with the express observation, that she with true zealous Christianity concerning this, remains for my Executor to judge whom I hereby also appoint Guardian of my children.
4th. Should my wife according to the judgment of the Executors not fulfill her duty towards her and my children, then the use of the interest of the two thirds of my property shall be withdrawn from herm, and the children placed and provided for with my parents or relatives or other Christianly people as my Executor may see fit.
5th. It is my will that after my death all my movable property without exception shall be publicly sold, and what my wife purchases the value thereof shall be deducted from her legacy.
6th. It is my will and I therefore appoint as Executors of my will Messers Barnhard Doll and Anthony Kaiser of St. Agatha in Wilmot.
7th. It is my will that the parcel of land in the Township of Hay, County of Huron, containing fifty acres which I have purchased of Wendell Kittle, my part of the Lot No 5 in the 9th Concession Township Hay as soon as possible at the latest next winter, be paid at the office and the deed thereof to be vested in the hands of my Executors.
8th. It is my will that should the said Wendel Kittle not be able to make up the necessary sum to pay his piece of land until then his and my land should at the same time be paid with my money and said Wendel Kittle shall in this case give security to the Executors for the sum of money of my estate which has been paid for his land at the office.
9th. I declare null and void all former wills by me made….
