    • A-1-53 James Fraser: The Last Will and Testament of James Frazer of the Village of Galt in the County of Waterloo, formerly of Murrayshire in that part of Great Britain, called Scotland, Stone Mason.

      …I appoint my wife Margaret Murray, and my two friends Thomas Blacklock and John Young to be Trustees and Executrix and Executors of my Will. I give and bequeath to my dearly beloved wife Margaret Murray one Bedstead with suitable bedding, six chairs, one sideboard, one clock and one table. I devise unto, and to the use of my said Trustees all the real estate and bequeath to then all the personal estate, to which I shall be entitled at my decease upon the trusts and subject to the declarations following. Upon trust, as soon as when to them may seem proper, to sell and convert into money my said estate, both real and personal and upon such terms as may seem to them most advantageous. Upon trust thereout in the first place, to pay or retain all my debts, and my funeral and testamentary expenses, and then next to pay to my eldest daughter Mrs Elizabeth Lunn, wife of William Lunn, the sum of Five pounds, which I bequeath unto her as a legacy, and to invest the surplus of the said trust monies in such securities as my said trustees may think best the annual income whereof shall be paid to my said wife Margaret Murray, during her life, which said provision shall be in lieu of Dower, and immediately after her decease to divide the said Trust Fund equally among all the children I shall have had by my said wife Margaret Murray - and if but one child, then to that child but if it shall so happen that at the time of the death of my said wife, no child of mine shall be living, of which she is the mother, or no child of such child, then the whole of the said Trust Fund shall revert to my daughter Elizabeth Lunn. And I declare that if any of my children, by my wife Margaret Murray, shall die in her lifetime, and any child or children of such child shall be living then the share of the said Trust Fund in favor of my child shall be payable then the Share of the said Trust Fund to which the child so dying would if living have been entitled under the trusts aforesaid, shall be payable, by my said Trustees to the child or children of such child, as the same would have been payable had such child of mine lived until the said Trust fund had come to dispose of as herein provided for….I hereby appoint my said Trustees Guardians of my infant children and dispose and commit the custody and tuition of them for such time as under the age of twenty one years, or being girls shall marry which first shall happen….
