  A-1-21 John Hewitt: Citation of the Heirs of John Hewitt, formerly of Wilmot, deceased. To William Miller, Esquire, Judge of the Surrogate Court, Waterloo. The Petition of Benjamin Godbold, of the Township of Wilmot, Yeoman. That John Hewitt, formerly of the Township of Wilmot, in the said County, Yeoman, departed this life on or about the twenty fifth day of September in the year of our Lord one thousand eight hundred and fifty one, leaving divers goods, chattels and credits within this County; that to the best of the knowledge of your petitioner the said deceased made and left no will at his departure, and therefore died intestate. That the said deceased left no widow lawfully to administer unto his estate, that your petitioner called upon the several sons of the said decease, viz: Joseph Hewitt, George Hewitt, John Hewitt and Elias Hewitt, all of them living within this County of Waterloo (Martin Hewitt, another son, living in the County of Oxford, was not called upon by your petitioner) neither of which said sons appeared desirous lawfully to administer unto the said estate, and moreover did hitherto actually fail to do so; this is necessary, in order to arrange and settle the estate affairs of the said deceased, and the goods, chattels and credits left by him your petitioner verily believes do actually suffer waste, there being no person lawfully to take charge of them not withstanding the long interval of time since the death of the said deceased, that Letters of Administration should issue to the Estate of the said deceased. …that the said deceased was at the time of his death not possessed of goods, chattels and credits to the amount of five pounds in two or more counties of this Province, or to that amount in any County of than this County of Waterloo. The prayer of your petitioner, he being one of the sons in law of the said deceased, therefore is, that letters of Administration be granted unto him in order that the said Goods, Chattels and Credits may be justly and truly administered as the law requires. Dated at Berlin, in the County of Waterloo 16 November 1853 Witnessed by C. Enslin, Registrar Administration granted to Benjamin Godbold of Waterloo. Citation of next of kin dated 19 November 1853 To Joseph Hewitt, of the Township of Waterloo, laborer, and to George Hewitt of the same place, laborer, and to John Hewitt, of the Township of Wilmot, yeoman, and to Elias Hewitt, of the same place, laborer, and to Charles Cooper, of the same place, yeoman, and Anne Cooper his wife, and Jacob Ollsh, of said Township of Waterloo, and his wife Sarah Ollsh, and to Joseph Wismer, of the same place, laborer, and Charlotte Wismer, his wife, and to Mary Hewitt, of the said Township of Wilmot, Spinster, all of the County of Waterloo, next of kin and interested as legal representatives in the Administration of the goods, Chattels and Credits of John Hewitt, late of the aforesaid Township of Wilmot, Yeoman, deceased. All were required to appear before William Miller, Judge of the court, in the Registry Room, Court House, town of Berlin, on Saturday the twenty sixth day of this present month of November at the hour of nine o'clock in the forenoon to show good and sufficient cause why letters of Administration to the estate of the said deceased shall not be granted to the said Benjamin Godbold, as prayed for, and why not rather you, and either of you, the said sons of said deceased as his next of him and hence first entitled…. None of these people showed up for the meeting so son-in-law Benjamin Godbold was granted Letters of Administrated. Letters Granted and issued 26 November 1853 to Benjamin Godbold.
