Second Trial Convicts Man of 1945 Murder
Kitchener (CP) - Henry Joseph Dietrich, 45, of Kitchener has been found guilty of non-capital murder in the 1945 shooting death of taxi driver Elmer Battler.
Mr. Justice Haines of the Ontario Supreme Court sentenced Dietrich to life imprisonment but said he will recommend that Dietrich be transferred to a psychiatric hospital. It was Dietrich's second trial in connection with the death of the Kitchener taxi driver July 13, 1945. Mr. Justice Haines said that while evidence indicated that Dietrich was not insane, he had been mentally ill for a long time. Dietrich was first arrested Nov. 23, 1963, in London, Ont.
He pleaded guilty to a charge of non-capital murder on Sept. 7, 1966, but later was granted a new trial by the Ontario Court of appeal on grounds that he had pleaded guilty to the wrong charge and no jury was empaneled when the plea was taken.

BATTLER, Clifford Morley - Sept. 25th, 1925 - Aug. 14th, 2006. Today, August 14th, 2006, our Dad and Poppa opened his last Nevada ticket and he hit the jackpot, Dad is homeward bound. No longer with us in body, he will be forever in our hearts and memories. Our Dad and Poppa told us often over the years that he was a millionaire many times over. When we asked him why, he would answer I have eight children, grandchildren and great-grandchildren who are all healthy and here, what more could a man ask for? This is the legacy he left to each one of us UNCONDITIONAL LOVE.Much loved dad to Joan, Karen (Rick) Clayfield, Douglas (Sharon), Russell (Debbie), Ronald, Judy (Daniel) Yearwood, Thomas (Toni) and John (Peggy). Poppa to 20 grandchildren and their spouses, each who have wonderful memories of their Poppa. Great-Poppa to 22 great grandchildren who brought him so much joy. Dad, each one of us had our special time with you to say our goodbyes, and to let you know how much you are loved. We all, Poppa, will celebrate the memories made and the times we cherish with a man who always provided unconditional love. We always knew, Poppa, that what you wanted the most, was the best for each and every one of us. This truth will live in our hearts forever.Clifford will be missed by his two sisters, Hazel Knight of Saginaw, Michigan, Elaine (Jack) Wilfong and brother-in-law, Gordon Witmer.Predeceased by his wife, Margaret Schedewitz, Feb. 28th, 2004.
