Aircraftsman Committed For Trial on Negligence Charge

Aircraftsman R. Hutchinson, Hespeler, To Stand Trial In Connection With Highway Death of Vernon Cressman, of Sunnyside.

    (By Staff Writer)

Charged with criminal negligence following an accident September 28 in which Vernon Cressman, Sunnyside, was seriously injured, Aircraftsman Robert Hutchinson, Hespeler, was committed for trial by Magistrate John R. Blake.

Police testified that Cressman was struck down by a car while he was walking on the Kitchener-Galt highway in front of his home. He died a few days later in hospital here.

Trial of Hutchinson, son of Dr. William Hutchinson, Hespeler, on two other charges, namely, leaving the scene of an accident, and dangerous driving, will not proceed until after disposition of the criminal negligence count, Magistrate Blake stated.

Prior to the hearing. Magistrate Blake pointed out that he, personally, was not willing to sit in actual judgment of the case "as the accused's father is a personal friend of long standing." "In the interests. of justice it is much better it be tried in a higher court." he stated.

Professor Joslyn Rogers, ananlytical expert at the University of Toronto, told the court that from examination of the fender of the car in which Hutchinson allegedly collided with the deceased, and the clothes which the victim was wearing, he was certain that "it could have been the accused's car which struck him". He pointed out however, that he could not be sure.

"Blue-green paint on the clothing was identical with paint on the fender, but then there are a great many cars of exactly the same colour," he testified.

P.TO. Edward Mitchener told the court that the accused, in company with his father, came to police headquarters in Kitchener the day
following the accident. "Hutchinson told me that he had heard about the accident and said he wanted to tell police that while he was driving between Sunnyside and Kitchener that night, his car struck something, but that he didn't yet know what it was," the constable testifled.

"He said he guessed he hit another car or a trailer, and after stopping a short distance past where the Cressman accident occurred, drove back towards Preston but didn't find anything except a dead cat."

Acting Inspector W. Oliver said he took Cressman's clothes and the bent fender of Hutchinson's car down to Professor Rogers at Toronto. It was not until after Dr. Rogers reported his findings that Hutchinson was charged.

Lincoln Shantz, Cressman's neighbour, said he was resting in his house when he heard a "thud". He rushed out without waiting to put on his shoes and saw Cressman lying in a pool of blood on the pavement.

Mrs. Cressman said her husband out of the house to go to the nearby store at 10.30 Saturday might. "I saw him to the door and then sat down waiting for him to return. I noticed a lull in the traffic on the highway, then heard car, apparently coming very quickly. The next thing I heard was a distinct thud. I sensed at once that my husband had been hit," she related. "I was so stunned, sat still in the room until they came to call doctors and an ambulance."

Ironically, Cressman was busy at Sunday School work the evening he was injured, or he would have gone out sooner, Mrs. Cressman
told the court. Summing up the case, Crown Attorney W. P. Clement asserted there are "too many coincidences to all short of identification" of the river of the car which struck Cressman.

"That is a matter for the jury decide," the magistrate replied. Defence Counsel R. Meyer, Galt, ontended that the Crown had failed to prove wanton recklessness.. |

"Thus man was hurled about 40 feet by the impact which certainly implies a degree of violence - or was it just a gentle push?" retorted
    the cadi.

In committing the acused for trial, Magistrate Blake declared: "It's one of those borderline cases and it is too important for me to
say there isn't sufficient evidence to try him on."

Hespeler Driver Acquitted In Death Of Sunnyside Man

Charge of Criminal Negligence Against Young Aircraftsman Is Dismissed; Vernon Cressman Died Shortly After He Was Found Lying on Highway.

    (By Staff Writer)

Judge E. W. Clement dismissed, a charge of criminal negligence against Aircraftsman Hutchinson in county criminal court here, Tuesday. Charge against Hutchinson, son of Dr. W. G. Hutchinson. Hespeler, was sequel to an accident September 28, on the Kitchener-Galt highway, which resulted in the death of Vernon Cressman, Sunnyside.

Police testified Cressman was struck down by a car while walking on the highway in front of his home. Removed to Kitchener-Waterloo hospital, he died a few days later.

In giving judgment, Judge E. W Clement pointed out that the crown, represented by Crown Attorney W. P. Clement had produced no eyewitnesses and no evidence of negligence. He indicated further, that the fact Hutchinson was in charge of the car which struck the deceased, had not been definitely established.

"Even assuming that it was Hutchinson's car which struck Cressman, there is no proof of negligence," he contended.

Crown Attorney Clement admit- ted there was "no direct evidence", but asserted there was sufficient evidence in surrounding circumstances to prove the accident Robert couldn't have happened, except for negligence on the part of the driver of the car.

    P. T. O. Edward Mitchener told the court that the accused, in company with his father, came to provincial police headquarters the day after Cressman was found lying in a pool of blood on the highway in front of his home.

"Hutchinson said he had heard about the accident and said he wanted to tell plice that while he was driving between Sunnyside and Kitchener that night, his car struck something but that he didn't know what it was," Constable Mitchener related.

Evidence by Prof. Joslyn Rogers of the University of Toronto analytical division testified that his examination of the victim's clothes and a dented fender of the Hutchinson car proved "It could have been Hutchinson's car which struck Cressman".

Crown Attorney Clement said he would "rest the crown's case on inferences that may be logically drawn from the evidence".

    Notes:

CRESSMAN, Esther Salome With heartfelt gratitude to God, we announce the peaceful passing of Esther Cressman into the presence of God at the midnight hour on Saturday, June 3, 2017. Born May 3, 1927, Esther was one month into her 91st year when the Lord called her home. She was predeceased by her father Vernon, mother Salome and sister Sarah and is survived by loving sisters Lois (John Kurtz) of Niagara on the Lake, Ruth Cressman and Elizabeth (Ed Weber) of Ottawa, as well as numerous nephews and nieces. Her nephew Phil Kurtz and family held a special place in her heart through the years and lived close to her. His poems and presence in her life brought her much joy. Esther was educated in Kitchener, ON and following a term at Emmanuel Bible College and nurses' training at Grand River Hospital, ventured onto the mission field in 1951. Bethany Missionary Church, Kitchener was her 'sending' church and they supported and prayed for her as she served as a nurse in Nigeria and latterly a language translator for some 27 years. She helped write the Dukawa language and thanks to her diligent work, a people group received the written word of God in their own dialect and many have come to faith as a result of this selfless woman's service to God. Her partner in translation was Donna Skitch, now married to Wally Uyeyama of Campbell River, BC, who remained her prayer partner and close friend throughout her life. Ever seeking to learn more about God, Esther returned to Emmanuel Bible College for further training in 1980, then took Biblical Counseling through YWAM Hawaii followed by serving four years in the Philippines with YWAM where she entered into a precious friendship with young Gary Hallman. Returning to Canada, Esther took the Crossroads Discipleship Training with YWAM Cambridge and served at Jacob's Well in Kitchener, touching many with her gift of hospitality and prayer. Esther leaves a legacy of many songs that she and Donna wrote and Esther composed for piano. All her life she sang of her love to the Lord; now she is singing to Him face to face. She has long had a heart for God's land and people of Israel and encouraged everyone to pray for the peace of Jerusalem. How fitting that she should pass into eternity during the week the world remembered the 50th anniversary of the Six Day War and the reunification of Jerusalem. Her final 11 years were spent fruitfully living in community with the Return Ministries' family in Bright, ON, an Aliyah ministry focused on partnering with God in the return and restoration of His North American Jewish people to Israel. Although Esther never married, she has had a lifelong relationship with Jesus, her eternal Bridegroom. Although she never had physical children of her own, she was a mother to many spiritual children all over the world. We wish to thank all the wonderful, caring staff at Sunnyside Home in Kitchener where Esther resided for the past 11 months. Their tender loving care made her final months manageable and in return, she blessed them with her affirmation, encouragement and prayer. A trio of good friends who watched over her in these years, Nancy, Theresa and Peg, are grateful to God for His provision of this care facility which just happened to be in Esther's old neighbourhood. Rather than fussing about leaving her Return Family last June, she praised the Lord for taking her full circle to a home that was halfway between her Bible College and Nurses' training hospital. Esther left a large deposit of God's love everywhere she resided. A private interment took place June 6, 2017. Esther's Memorial Service will be held on Sunday, June 25th from 4:00 to 7:00 p.m. with light refreshments. Please RSVP and leave message of how many coming at 519-684-7198. Location: Return Ministries 907168 Township Road 12, RR 4, Bright, ON.
