    Notes:

    Another early manufacturer was Matthias Wegenast who built a factory for the manufacture of furniture, and was successful, but several fires proved a severe handicap. The factory was later taken over by the Canada Furniture Manufacturers Limited.

    A gloom was cast over the Town on Monday noon when the news spread that Mathias Wegenast for many years one of our most prominent manufacturers and most highly esteemed citizens had joined the silent majority. The subject of this sketch was born on June 27th, 1828 in Holtzhaussen, Wuertemburg, Germany, so that on the date of his death he attained the ripe old age of 70 years, 8 months and 6 days. At the age of four his parents emigrated to America, living for several years in Boston, Mass. Later they removed to the Niagara (Ont.) district, living for some years in a small village known as Black Creek near Niagara Falls, where his father engaged in farming. The tales of hardship endured by those early settlers were frequent subjects of narration of which the deceased had a vivid recollection. In 1841 his parents removed to the T'p of Wilmot Co. Waterloo, then a dense wilderness, where they hewed out for themselves a home, as did some others who took up land on or about the same time in the vicinity of Petersburg. In 1847 at the age of nineteen, the deceased was apprenticed to the late John Hoffman, of Berlin, then engaged in the manufacture of furniture, sash, doors, etc, where he learned his trade, as cabinet maker, joiner, etc. The writer recalls may incidents related by the deceased of the years spent in the employment of Mr. Hoffman, among his associates and fellow apprentices being a number who were destined in later years to distinguish themselves in manufacturing circles. After a few years subsequent to his being a "journeyman," he launched out on his own account as a manufacturer of sash, doors, etc, in Berlin, in a small way, but being ambitious, he looked forward to more extensive operations, and accordingly he entered into partnership with John S. Hoffman of Berlin, who together built for themselves a factory in Waterloo upon the site now occupied by Schaefer, Killer & Co, where, however, after a brief experience they were burnt out. Nothing daunted the enterprise of the deceased and he resumed business on his own account in a building situated on the vacant lot near the present skating rink, where after only a few years of successful operation he was burnt out for the second time. This fire is in the remembrance of the writer, who recalls the only method then known of fighting fire, namely, pails of water, passed from hand to hand from the creek nearby. Needless to say the fire could not be checked in this way and the loss was total, nothing being saved. By means of the insurance he carried he was enabled to commence business again in a small way, upon the old site on King street, where he erected a factory to which he added from time to time as he prospered. Here he succeeded in building up a large trade, chiefly in the lumber and sawmilling lines but he was destined once more to be a victim of the ravages of a fire, this time to an extent more serious than had fallen to his lot previously. During the winter months of 1875-76, he laid up an unusually large stock of his manufactures and when the fire occurred, (in May 1876) his factory was filled with the stock he had prepared for the business of the coming season, and the loss was correspondingly great. Although in this instance he carried a fairly large amount of insurance, the loss was heavy. Together with the former fires, it is safe to say that his total losses at the three different times mentioned were equal to a handsome competence. This time his courage was about exhausted, and only for the assistance afforded by the town in rebuilding the factory he would no doubt have been compelled to retire from business altogether. At this time he associated with himself the late Isaac Hoffmann and Adam Klippert, who together built the factory now operated by Schaefer, Killer & Co., where he remained in business until within a few years ago. There are few men with so varied and with unfortunate experience in business as the deceased passed through, and few indeed who lived to reap so small a reward for years of patient hard work against the misfortunes ever recurring. As an employer he was kind and considerate and enjoyed the esteem of his employees many of whom worked for him continuously for upwards of thirty years. During so active a life, the demands upon his time were such as to prevent his taking any part in municipal affairs. For a time he was a member of the School Board, and for one year we believe, he was a member of the Town Council, but he never aspired for any positions. In politics he was a life-long Liberal, but as in municipal matters he found no time to devote to anything but his own immediate affairs. For the past three years he has enjoyed a well earned rest living as he had for over thirty years, in the homestead on King street well known to the readers of the Chronicle. In July last, he had the misfortune of falling from a ladder while picking cherries, when he sustained severe injuries. When nearly recovered from this mishap, he met with a second and almost fatal accident, having been run into by a bicycle while crossing the road near the Post Office. From the effects of this he never recovered, having been injured internally. While able to move about during the past few months he complained of constant pain which increased as time went on until about 10 days ago, his physician advised that nothing short of an operation would afford relief or save his life. For this purpose he was removed to the Berlin and Waterloo Hospital on Saturday Feb 25th where he was successfully operated on by Dr. Howitt of Guelph, on March 1st. While relieved of the intense suffering by the operation his weakened condition could not withstand the strain under which he sank gradually, death relieving him on Monday morning, March 6th. In 1850 he married Salome Staebler who with five children survive him. George, Manager of the Ontario Mutual Life Ass'ce Co, Waterloo; Isaac, Traveller for the Vokes [?] Hardware Co., Toronto; William, in the J. B. Snider Co, Waterloo; Carrie, at home; Mary, wife of James A. Miller, Lancaster, Pa. Two children pre deceased him, Catharine, wife of Levi Graybill, who died on March 5th, 1889; and Samuel, who died on December 6th, 1886. Early in life he joined the Evangelical Association through the labors of the late Rev Wm Schmidt the pioneer missionary of the above religious body. His remains will be interred today (Thursday) in Mount Hope Cemetery.

    King Street Kitchener

    "In 1850 John Winger erected a building about half way between Gaukel and Foundry Streets and occupied the first floor as a pump factory. He used steam power, a novelty in those days, and had an old-fashioned upright engine built by Crombie & Co. of Galt. He made pumps, broom handles, etc. The second floor of the building was operated by Matthias Wegenast as a sash and door factory. Later there was a saw mill in the basement. Several accidents occurred in this saw mill; Helwig Scholl's leg was cut off as was also John Koch's arm, by the saw. Mr. Winger, apparently in difficulty with his creditors, suddenly left the village, after which the building was taken over by Martin Simpson, who had operated the Bowman & Correll factory at the east end of the town, and the building became known as the Simpson factory, the product being mostly furniture. At the rear of the Simpson factory stood a two storey frame building, used by W. H. Goetze, (cousin and brother-in-law of Louis Breithaupt) as a tobacco factory. Mr. Goetze came from New York early in the 60's. During the closing years of the American Civil War the factory found difficulty in getting tobacco, then mostly supplied from the Southern States."

    King Street , North Side

    Foundry Street (now Ontario Street).

    Jacob and John Hoffman, brothers, who came from Pennsylvania, erected a furniture factory on the corner about 1840. It was a two story frame building extending along King St., had 25 to 30 employees and a 15 h.p. engine brought from Buffalo.

    Eby's history gives John Hoffman as having come from Pennsylvania in 1825; Jacob, almost two years older, seems to have come before. They both worked at carpentry, etc., for a number of years before starting the factory in which enterprise they were assisted by Benjamin Eby. On the ridge of the factory roof there was a belfry with the only larger bell in Berlin. This bell served not only the factory but the village as well, pinging at 7 in the morning, at 12, at 1 and at 6 o'clock in the evening. It was used also as a fire bell and was tolled for funerals.

    By some prank or spite the bell was stolen in 1850 before there was a night watchman at the factory, and disappeared for two or three years. Eventually it was found in a well at the comer of Duke and College Streets, put back in place on the Hoffman factory and later was taken to a belfry on the Simpson factory spoken of, where it was used until this factory was discontinued. It was then taken to the pavilion in Victoria Park and was melted down when the pavilion was destroyed by fire.

    Behind the Hoffman factory there was a pond, about three feet deep, fed by a spring, the water being used for the factory boiler, etc. About 1860 a frame building, used by the firm for a warehouse, covered the site of the spring. Further back there was a saw mill, also a planing mill, the first of its kind in Berlin. A two story frame building extending along Foundry Street was later added to the factory and used as a turning shop. At the rear of this building was the factory boiler house.

    Next to the factory on King Street there was a three story brick building. The ground floor was used as a store, called the Berlin Warehouse. Jacob Hoffman, who by this time was alone in the business, John having gone to Waterloo, announced himself as dealer in dry goods, groceries, hardware, china, glassware, crockery, and paint and oils and manufacturer of all kinds of furniture, also sash doors, etc., selling low for cash. An overhead passage way on a bridge connected the second stories of the factory and brick building. Over the store was the paint shop and in the rear a warehouse. Hoffman's store was later occupied by William Schmidt, son of Rev. Wm. Schmidt, an early minister of the Evangelical Church. Schmidt had a dry goods store only, known as the Golden Lion store because of a large gilt lion over the entrance. Isaac Hoffman, son of Jacob, carried on the factory and store for several years; later John S. Anthes was in possession while Hoffman went to Waterloo and continued the furniture business there with Adam Klippert and Martin Wegenast as partners. Jacob and John Hoffman erected a number of houses in Berlin.

    Jacob Hoffman was very stout, weighing over 300 pounds. He was a member of the Evangelical Church. For a time he served on the village council. He resided on Foundry Street in the rear of the Canadian Block in a square, hip roof, two story, frame house, until it was destroyed by fire, when he moved to the west side of Foundry Street, south, where now is the Robe & Clothing Co. building. Here he had a one and one-half story frame house with a large two story addition at the rear where were lodged apprentices and other factory employees. There was a small portico over the front door and a porch extending along the northerly side of the house.

    Next to the Hoffman warehouse there was a saloon and restaurant occupied by a Mr. Unger. He served, among other things, oysters which came in small wooden, 1-gal. kegs. Adjoining Hoffman's store there was the tailor shop of H. J. Nahrgang, later occupied by Henry Glebe, an early band master; next a store differently occupied at various times and next the shoe store of Wm. Niehaus. A three story brick building occupied by Wm. Young as a grocery. Mr. Young eventually went to the Canadian Block and the store was used for various purposes, among them auction sales in the evening. Here there was sold the first white crockery offered in Berlin. Later the building was occupied by the Berliner Journal.

    A one and one-half story frame building with gable toward King St. and a veranda, occupied by Mr. Fuchs, a tailor and shoemaker, whose wife assisted her husband as expert in repairing clocks. The family lived in the building. About 1865 the frame building was moved to the rear and Fuchs' block erected on the street. The ground floor had three stores, the west one occupied by Mr. Fuchs, the middle by John Kayser, dry goods merchant, and the third one by Tindall Simpson and Sons, shoemakers and tailors. The first building on part of the Fuchs' block site was a rough frame structure used by one Susand, colored, who was the first barber in Berlin.

    A two story brick building with gable facing King Street, occupied by Christian Garman, harness maker, who later moved to New Hamburg and started a tannery. This building was later occupied by Levi Gaukel, son of Frederick Gaukel, after his father's death. He had a small hotel known as The Red Lion. In 1860 Urban Prinzer succeeded Gaukel and continued the hotel for a short time.

    A two and one-half story brick building with gable facing King St. was occupied by Levi Gaukel, as a butcher shop after he gave up the hotel next door. Jacob Gaukel was associated with Levi. Later George Debus occupied this shop.

    On the corner of King and Queen Streets there was first a driving shed for the Gaukel hotel opposite, until the Bowman block was erected in 1860. This was a three story brick building lengthwise with King Street. Joseph Bowman the noted violinist occupied the third floor of this building. Half of the ground floor of the building was occupied by Henry B. Bowman with a partner Heins as general dry goods store. This was on the corner. The other half was a brick store occupied by Cole and Graf, druggists, and later by Wm. Bowman in the same business. On the site of the Bowman block is the handsome Bank building built by the Merchants Bank and now occupied by the Bank of Montreal.

The late Mrs. Shreve is survived by two daughters, Mrs. Edmund Kratsch of Milwaukee, and Mrs. E. Byron O'Neill of Chicago, one son, Eric, of Detroit, two brothers, Samuel Krupp of Detroit and B. F. Krupp of Illinois. Also a sister, Mrs. Fred Meyers, of Lansing, Mich.

    WEGENAST, FRANKLIN WELLINGTON, teacher, musician, lawyer, politician, and author; b. 17 June 1876 in Waterloo, Ont., son of Martin Smith Wegenast and his second wife, Dinah Sauer; m. 14 Aug. 1901 Margaret Mary Bell (1878\endash 1950) in Oxley, Ont., and they had three daughters and two sons, of whom only one daughter, Elsinor Louise, survived infancy; d. 2 June 1942 in Preston (Cambridge), Ont., and was buried in Oakwood Cemetery, Simcoe, Ont., beside the four children who had predeceased him.

    Franklin Wellington Wegenast grew up in a German Canadian household with ties to the Evangelical Association, a Methodist group formed in the United States by members of the Pennsylvania Dutch community in 1800. (In later life he would become an Anglican.) At one point he boarded with an Amish family and this experience, in conjunction with his own evangelical background, encouraged a lifelong interest in the Mennonite faith. From his early years, he was involved with music. Said to have begun supporting himself at the age of 12, he nevertheless managed to graduate from high school in Berlin (Kitchener).

    In 1898, having obtained a teacher's certificate, Wegenast began his pedagogical career in Colchester South, Essex County. He also studied music and organized concerts at Harrow and Kingsville. In 1900, now living in Simcoe, he taught music in the public schools, gave private singing lessons, continued to put on concerts, and acted as choirmaster at St Paul's Presbyterian Church. He also prepared for an associate diploma in singing at the Toronto Conservatory of Music [see Edward Fisher*], from which he graduated with honours in 1902. By that time he was residing in Woodstock and conducting the choir of Central Methodist Church there.

    An interest in law had developed over the years, and Wegenast became articled to attorney John Soper McKay while in Woodstock. In 1905 he moved to Brampton and commuted to Toronto for courses in law at Osgoode Hall. In order to support himself and his wife, he became choirmaster of the Brampton Presbyterian Church, serving there until his resignation in 1915. For two years, in 1906\endash 7, he conducted the Brampton Choral Society, and he also wrote music. He graduated from law school in 1909 and won Osgoode's Christopher Robinson Memorial Prize. The following year he took the exams for an llb at the University of Toronto and passed with first-class honours.

    In 1908, while still a law student, Wegenast had asked the Board of Railway Commissioners to compel the Grand Trunk Railway to include Brampton among the towns eligible for cheap commuters' tickets to Toronto; the matter would eventually be taken, unsuccessfully, to the Supreme Court of Canada, where he helped present the case on behalf of the City of Toronto. After his graduation Wegenast joined the Brampton law office of Benjamin Franklin Justin, where he spent four months, practised alone for a similar length of time, and then became counsel to the Canadian Manufacturers' Association (CMA), whose first legal department he organized. He remained with the association for seven years.

    During his career he appeared in a series of actions involving constitutional law and the respective rights of the dominion and provincial governments. For example, he represented the CMA in the insurance reference case of 1912, which the Supreme Court of Canada decided the following year by ruling ultra vires the attempt by Sir Wilfrid Laurier*'s government to require federal licences for insurance companies operating in more than one province. He also argued before the Judicial Committee of the Privy Council in London, England, his first case being John Deere Plow Company v. Wharton in 1914, in which he was opposed by Edmund Leslie Newcombe*, who argued the federal side. War broke out while he was in England, and he stayed on for a time in the hope that his ability to speak German might help the British cause.

    Wegenast had also represented the CMA during a three-year investigation into the liability of employers for workplace injuries, begun in 1910 by Commissioner Sir William Ralph Meredith*, and he subsequently prepared a draft of a workmen's compensation bill for Ontario. The draft was rejected by Meredith, but the CMA was able to win some concessions as the commissioner's own bill proceeded through the legislature. Wegenast drew up possible legislation in the same field for Nova Scotia and New Brunswick as well, and the compensation acts of these and other provinces were largely based on the bills he had formulated. In 1911 he brought out a pamphlet, Workmen's compensation for injuries … (Toronto), and also a book, Extra-provincial corporations … (Toronto). Under the auspices of the CMA he later became involved in organizing safety groups in factories, and he would be for a time secretary to the Federation of Safety Associations \endash the precursor of Industrial Accident Prevention Associations, formed in 1917. His interest in workmen's compensation gave his career a nationwide dimension, as did his involvement in insurance matters. According to the Bench and Bar in 1936, "He has had a hand in framing insurance legislation in all of the provinces." In 1917 he was called to the Manitoba bar.

    In the early 1920s Wegenast acted as secretary and legal adviser to the commission investigating the operations of the Hydro-Electric Power Commission of Ontario [see Sir Adam Beck*]. He focused as well in this decade on the writing of a book on company law. Margaret Paton Hyndman*, who had joined his firm in 1920, worked closely with him on this project. Wegenast's support of a young woman practitioner was unusual at the time. The book, The law of Canadian companies, was published in Toronto in 1931. Two years later Wegenast was made a kc.

    A long-time member of the Peel Liberal Association, Wegenast sat on the Brampton town council for many years from 1909, was reeve in 1923 and 1924, and served as mayor from 1925 until 1928 and again in 1930. He beautified the southern entrance to the commercial district by straightening the creek that ran through the area and building retaining walls for it. From 1914 to 1917 he was president of the local Board of Trade. A member of the Brampton Horticultural Society, he enjoyed landscape gardening, and he kept sheep, ducks, and horses on his property, which consisted of 25 acres on Highway 10 (Main Street). While he had less time for music, he still managed to sing at concerts; as late as 1940 he would be a soloist at the Brampton Presbyterian Church. A linguist who was fluent in French as well as English and German, Wegenast studied Italian and then Chinese. Since he was able to speak Gaelic, having picked it up in J. S. McKay's law office, many people in Brampton thought him a Highlander.

    One of Wegenast's clients was Alvin Ratz Kaufman*, owner of the Kaufman Rubber Company in Kitchener [see Jacob Kaufman*]. Philanthropically inclined, Kaufman gave to local charities and in 1931 founded the Parents' Information Bureau. This organization sent out agents who offered advice on birth control as well as contraceptive devices at cost. The bureau's service spread outside Kitchener, and in September 1936 one agent, Dorothea Palmer*, was arrested in Eastview (Ottawa) and charged under the Criminal Code with "offences against morality." Kaufman was prepared to fight the case with all his resources. His interest in birth control stemmed from his concern with over-reproduction among the poor, his alarm at the power of the Roman Catholic Church, and his bias against French Canadians.

    Some scholars have concluded that it was because Wegenast shared Kaufman's eugenic views that he took the case. Evidence does not support this theory. Wegenast did not want to be involved in the trial: he had no interest in contraceptive campaigns or in related sterilization movements. Kaufman later claimed that he had had to persuade Wegenast, said to be in poor health, to appear in the action. Having agreed, Wegenast focused on the legal questions surrounding birth control as well as on the rights of women. He organized his arguments to prove that birth control was pro bono publico. "No one," he stated bluntly, "is entitled to get up in this court and argue that the chief end of man is to bring into the world as many souls as possible to become baptized and to praise the Lord for ever and ever." In March 1937 he won the case, thereby setting a legal precedent in the area of birth control. The trial apparently prompted an involvement in eugenics, for at some point he joined the Eugenics Society of Canada.

    In the spring of 1938, after Wegenast had suffered a heart attack, Kaufman funded a four-month rest trip for him in Europe, during which he kept a journal of his impressions. After World War II broke out the following year, he became head of the enrolment section of the Brampton win-the-war committee; according to his daughter, also a lawyer, his professional practice nevertheless suffered because of his German background. In May 1942 he went to stay at the Preston Springs Hotel, a favourite haunt. Several days after his arrival he died there of kidney failure. His wife survived him for eight years and was buried beside him in Oakwood Cemetery.

    Funeral For F.W. Wegenast K.C. At Brampton Today

    A prominent Brampton and Toronto barrister, and well known in the Twin City, Franklin W. Wegenast, K.C.. died Tuesday night at Preston Springs, Preston. He was in his 66th year.

    A resident of Brampton, Mr. Wegenast was a member of the law firm of Wegenast and Hyndman. Deceased suffered a stroke while working in Timmins. He succumbed after several weeks' illness.

    Mr. Wegenast once taught school in Wellesley, and for a time about 50 years ago, was employed by The Waterloo Chronicle. He was the author of several well known law books.

    Besides his wife, the former Margaret Bell, he is survived by one daughter, Mrs. W. E. R. DeRoche. Toronto, and four sisters, Mrs. W. H. Grenzeboch, Woodstock; Miss Sarah, Waterloo; Miss Ida, Toronto and Mrs. O. I. Groh, Preston. One brother, Edward, of Winnipeg, also survives.

    Funeral services are being held this (Friday) afternoon at 2 p.m., in Brampton.

    WATERLOO WOMAN HURT

    When she was struck down by a car driven by Edgar Schlosser at the corner of John and, King streets, Waterloo, last Wednesday, Miss Sarah M. Wegenast suffered scalp and neck injuries. She was removed to the K.-W. Hospital where she recovered consciousness. Dr. H., J. McNally attended her. Her many friends are pleased to learn her condition is not serious.

    X-ray pictures taken by the attending physician, Dr. McNally, revealed the fact that Miss Wegenast had a fractured pelvis and was suffering from concussion of the brain.

    Drowned While Bathing

    Alva Grenzebach, a young farmer, of East Zorra, was drowned at Lakeside, near Woodstock, last Thursday evening while bathing. He was unable to swim, but had been holding on to a piece of wood, which floated out into deep water. Several companions were with him and they noticed his hands suddenly slip from the buoy he was holding and saw him sink. He was not seen to again rise to the surface. Grappling hooks, and rescuers at once set to work and the body was recovered, death having taken place within a short time after the submerging. The body had lodged in the mud at the bottom of the lake and was recovered with difficulty. The late young man was 21 years of age.

    We are indeed sorry to mention the untimely death of one of Zorra's bright young men in the person of Mr. Alvin Grenzebach, son of Mr. and Mrs. Wm. H. Grenzebach, who lost his life at Lakeside while bathing. The funeral, which was held last Saturday at the 17th line cemetery, was well attended, which plainly showed the high esteem in which our young friend was held. The whole community of Zorra really feels sorry for Alvin's father and mother and brothers and sisters in their bereavement. Sweetly does he slumber. He's gone, but not forgotten.
