- The subject of the following reference in the editorial columns of the Mower County, Minu., Transcript was brother to Mr, William H. Smith, High Constable of this county: "On Monday morning last Sylvester Smith was found dead in his bed, He had been out of health during several weeks, some of the time confined to the house, but lately he had been about the streets as usual and the evening before his death he retired, feeling unusually well. He was the victim of apoplexy, and no doubt passed away unconsciously and without any immediate premonition of the change. Deceased was fifty-three years, two months and nineteen days old, and had resided in Austin continuously since 1855 being twenty-two years. It will thus be seen that he was one of the very first settlers." Possessed of a vigorous intellect and energetic will, he early took a leading part in all matters whether of society, politics or business, and continued, although with activity somewhat abated, to manifest a deep interest in all matters of public concern.
Probably no man in this community had more natural kindness of heart than had the deceased. It seemed always a delight to him to aid his fellowmen, and there are hundreds in this County to-day that have felt the benign influence of his boundless benevolence, and still hold him in grateful remembrance for favors received at his hands. The worthy never made application to him for assistance in vain. The funeral was more largely attended than any other we have ever witnessed here. The Rev. O. Williams conducted the services at the house, the funeral being attended by a large number of the Masonic fraternity, of whom the deceased was an honored member.

The great case of Mower County against Sylvester Smith, who was Treasurer of that county, some seven or eight years ago, which has been figureing in the courts for years was, recently decided in favor of the defendant, by the referees, Hon. J. Weswell, of Mankato, Hon. L. L. Wheelock, of Owatonna, and Mr. Edward Conkhite, of Fillmore county. When the charge was first brought, an expert was employed, who found that on the face of his books, Smith was indebted to the county some forty-thousand dollars, and the first referees decided accordingly. A second reference whittled the stealings down to $17,500. Smith appealed to the Supreme Court, and his case was again submitted to the three referees above mentioned for re-examination, and after a thorough and exhaustive examisation, they have completely exonerated Mr. Smith, and decided that instead of owing the county $40,000, or $17,000, he does not owe it a cent. - Exchange.
