    • Wins Appeal, Mrs. Paepcke Given Liberty

The final court chapter in the year-old Paepcke case was written in Toronto today when the Ontario Court of Appeals quashed an assault conviction against Mrs. Sheila Winnifred Paepcke.

The Elmira woman was sentenced to 18 months when convicted by a county court jury in November on a charge of assault causing bodily harm.

      CONVICT HUSBAND

In quashing the conviction, the appeal court ruled there was insufficient evidence for the conviction.

Mrs. Paepcke's husband, Henry William Paepcke, was convicted on the same charge and serving two years in Kingston penitentiary.

The charges arose out of the death in January, 1953, of the couple's daughter, Glenis, three, at the Paepcke home in Elmira.

Both Mr. and Mrs. Paepcke were acquitted last year on charges of murder and manslaughter in connection with the tot's death.

      FIND 75 BRUISES

The court. during hearing of the assault charge, was told that about 75 bruises were found on the child's body, abrasions on the face. a bruise on the scalp and evidence of a subdural hemorrhage.

Elmira Police Chief Harry Jarvis quoted Mrs. Paepcke as saying the child had fallen from a toilet seat. The chief also quoted Mr. Paepcke as admitting he had strapped the child with his belt the day before.

Mrs. Paepcke's counsel, Roy Youngson, appeared on the appeal today at Osgoode Hall.
